APPLICATION UNDER SECTION 142 OF THE NEGOTIABLE
INTRUMENTS ACT, 1881 FOR SEEKING CONDONATION OF DELAY
IN FILING PRESENT CRIMINAL COMPLAINT
MOST RESPECTFULLY SHOWETH:
  1. That the present Complainant has been filed against the Accused under
     Sections 138, 141 & 142 of The Negotiable Instruments Act, 1881 for
     dishonour of cheques bearing no.000254 and 000176 dated 28.10.2024 of
     Rs. 75,000/-(Seventy Five Thousand Only/-) and Rs.35,000/- (Thirty Five
     Thousand Only/-) respectively issued by the Accused No. 1 as security for
     the assets taken by him on rent.
  2. That the contents of Complaint may be read as part and parcel of this
     application in order to gather the factual matrix of the dispute and the same
     are not being repeated herein for the sake of brevity.
3. That the present application is being filed for seeking condonation of delay
   in filing the above-captioned Complaint. It is submitted that complainant
   e-filed the present complaint on 13.01.2025 as same given initial number
   i.e. ADL20230002698C202500003. The photo of the filing details of case
   are annexed as Annexure-A1.
4. That the e-filed case of the complainant was rejected on 18.01.2025 due to
   technical issues same was available for correction on e-filing portal on
   18.01.2025. That the counsel for the complainant after correcting the case
   gave the same to its clerk for filing on 24.01.2025.
5. That the clerk of the counsel for the complainant on 24.01.2025 due to
   inadvertent mistake instead of refiling the case file deleted the same from
   the e-filing portal. The printout of the e-portal showing the case bearing
   no. ADL20230002698C202500003 as deleted is annexed as Annexure-
   A2.
6. That the counsel for the complainant on 25.01.2025 and 27.01.2025 went
   to registry and also the computer branch but the deleted e-filed case was
   not restored. That having no other alternative the complainant again filed
   the same case on 29.01.2025. The acknowledgement receipt dated
   29.01.2025 is annexed as Annexure-A3.
7. That due to the above mentioned reason the Complainant was unable to file
   the present Complaint within the time limit prescribed by the law. That
   there is delay of 5 days in filing the present complaint. That the delay in
     filing the present Complaint is neither intentional nor deliberated but for
     the bona fide reasons as stated herein above.
  8. That the Complaint has a prima facie good case on merits and the balance
     of convenience is also in favour of the Complainant. That the Complainant
     shall suffer irreparable loss and grave prejudice in the case the delay in
     filing the Complaint is not condoned.
  9. That the application is bonafide and in the interest of justice.
                                      PRAYER
     It is, therefore, most respectfully prayed that this Hon’ble Court may be
     pleased to:
        a) Condone the delay, of 5 days in filing the Complaint, and
        b) To pass any other or further order as this Hon’ble Court deems fit
            and proper in the facts and circumstances of the case.
