It is to submit that an initial layout was prepared and
approved by the Visakhapatnam Metropolitan Region Development
Authority (VMRDA) under Mixed Land Use vide L.P. No.
85/2021/1167/VMRDA/DPMS dated 23.03.2022, comprising of 7
plots along with necessary amenities and for an extent of Ac 46.79
cts which was auctioned as per the directives of Government which
has permitted for conducting online auction through M/s MSTC, a
Government of India Under taking vide Government Letter
No.1423875/UH – 2/2021, MA&UD Department, dated 04.05.2022
duly approving the auction conditions and also having an Upset
Price of Rs.60,000 per Sq. Yard but in the auction no one has
participated.
Further, it is to submit that a PILL vide W.P.No.93/2022 has
been filed by Sri Velagapudi Ramakrishna, Hon’ble MLA, East
Constituency, Visakhapatnam before the Hon’ble High Court of
Andhra Pradesh on 13.06.2022 and prayed for set aside the online
auction notified by the APRSCL. Accordingly, Interim Orders has
been issued by the Hon’ble High Court of A.P and issued Stay
Orders. Counter Affidavit has been filed before the Hon’ble High
Court of A.P on 30.06.2022 in due course of time the Hon’ble High
Court has delivered its Judgment on 15.11.2023 and dismissed the
W.P. No.93/2022 and all interim orders are stands vacated.
The Government has constituted a Committee dated
28.11.2023 for fixation of Upset price and Terms& Conditions of
Auction.Committee has convened the Meeting on 01.12.2023 and
submitted its recommendations which were submitted to
Government vide Minutes of the Meeting, dated 01.12.2023.
1. Considering the demand and with an objective to provide a
greater number of plots and make land sizes more affordable, a
revised layout was proposed, increasing the number of plots to
20 from 7 plots. The revised layout was duly processed and
approved by VMRDA vide File No. 1167/0116/LP/VMRDA/2021 on
01.12.2023. The upset price for the plots was fixed at ₹60,000
per square yard, and an online auction was conducted through
MSTC, Visakhapatnam, on 28.12.2023. In the said auction, two
plots were successfully sold at the rate of ₹60,500 per square
yard, specifically Plot No. 1 and Plot No. 19. After survey of expo
conducted by CREDAI in Visakhapatnam in which APRSCL has
participated public suggested opting for lesser size plots for more
demand. Keeping in view of demand APRSCL prepared a revised
layout consisting of 78 Plots keeping the sold out plots 1 and 19
undisturbed.
It is to submit that at the time of auction Plot no 1 was
having an area of 3550 square yards and auction was conducted
on 28.12.2023and knocked down in favor of Smt.SeguSatyavathi
with a bid price of Rs.60,500/- per square yard. As per the
auctioned layout the plot was having size of 54.04m X 54.93m
(admeasuring West side 55.13 Mtr, East side 54.65mtr, south
side 54.04 mtr and North side 54.04 mtr) approx having an
extent of 3550 square yards ( Enclosure -1) and having utility as
its boundary on east side and 12.00 mtr road on north side and
30.00 mtr road on south side and plot no 2 on west side.
Further, it is to submit that survey of expo conducted by
CREDAI in Visakhapatnam in which APRSCL has participated
public suggested opting for lesser size plots for more demand.
Keeping in view of demand APRSCL prepared a revised layout
consisting of 78 Plots keeping the sold out plots 1 and 19
undisturbed, and submitted the layout to VMRDA which was
approved vide File No. 1167/0116/LP/VMRDA/2021 in which new
plots has been formed on the east side of plot no 1 but the area
of plot no.01 is same as 3550 square yards.
Meanwhile, it was noticed that the said land is in Prohibitory
List under Section 22 – A (1) (b) and hence, the District Collector
was requested to de-notify the said lands vide Letter No. 01
GM(P)/2024/ APRSCL/Land/ VSKP, dated 01.04.2024 &
23.05.2024.Tahasildar, Visakhapatnam Rural has recommended
for its de-notification and submitted proposals to Revenue
Divisional Officer, Bheemunipatnam vide
Rc.No.130/2008/Spl.R.I/Dated 28.05.2024 for an extent of 43.31
Acres as on ground which has been denotified.
This office conducted a DGPS survey to check the extent of
layout and found discrepancies inall over boundary by the end of
2024. The area of plot 01 came less of 150 to 200 square yards is
due to change of actual survey of boundary at gitam side which
is adjusted in layout along with 2plots i.e., 69, 68 at east side by
dragging the east boundaries towards east for an length of 9.00
mtrs for three plots each having 3 meter elongated. Now the
measurement of plot no 1 arrived is 57.53 Mtr x51.59 Mtr approx.
(Admeasuring West side 53.94Mtr, East side 52.07mtr, south side
57.16mtr and North side {39.93 Mtr +17.44 Mtr) having an
extent of 3551.43 square yards ( Enclosure -2) and the same was
prepared in the latest drawing as per DGPS survey and the same
was uploaded for approval. The old approved layout while the
time of auctioning didn’t show the clinked portion.
