12 Admissibility of SECTION I - LOSS OF OR DAMAGE TO THE VEHICLE Sec I of Policy

Section II of Policy
For own damage claims to be valid, the loss or damage Wording - Page 1
must result from insured perils like fire, burglary, riots,
earthquakes, floods, accidents, malicious acts, terrorist
activities, transit by road/rail/waterways/air, and
landslides under Section 1 of the policy. Claims are valid
only if the driver held a valid license and was not under the
influence of alcohol or drugs at the time of the accident.
The vehicle must have been used according to the
'Limitations as to Use' specified in the policy.

The policy does not cover consequential losses, normal


wear and tear, mechanical/electrical breakdowns, or
incidents like acts of nuclear risks, war risks, contractual
liabilities, and usage outside geographical limits or by
unauthorized persons.
In case of a claim, the insured should promptly notify the
insurer, file an FIR if require, and provide all necessary
documents as per policy terms.

For each and every claim under Section I (loss or damage


to the vehicle), a compulsory deductible amount as
specified in the policy schedule will be borne by the
insured.

The insurer's liability is primarily determined by the scope


of coverage under each section, the Insured's Declared
Value (IDV) of the vehicle, the specified limits of
indemnity, applicable deductibles/depreciation, and
compliance with the Motor Vehicles Act requirements.

SECTION II - LIABILITY TO THIRD PARTIES


1.Subject to the limits of liability as laid down in the
Schedule hereto the Company will indemnify the insured
in the event of an accident caused by or arising out of the
use of the vehicle against all sums which the insured shall
become legally liable to pay in respect of :-

i. death of or bodily injury to any person including


occupants carried in the vehicle (provided such occupants
are not carried for hire or reward) but except so far as it is
necessary to meet the requirements of Motor Vehicles
Act, the Company shall not be liable where such death or
injury arises out of and in the course of the employment
of such person by the insured.

ii. damage to property other than property belonging to


the insured or held in trust or in the custody or control of
the insured.

Procedure for Cashless Service & Reimbursement Claims


1. Submit Claim Form: Complete the claim form and
submit it along with all required documents, including the
driving license, vehicle registration certificate, repair
estimate, repair bills, payment receipts, and KYC of the
policyholder. Specific claim-related documents will be
communicated separately.
2. Vehicle Inspection: The insurer will assign a surveyor to
conduct a physical survey or virtual inspection before
repairs. Approval from the insurer is required before
starting any repairs.
3.Repair at Network Garage: If using a Bajaj Allianz
preferred network garage, cashless service is available.

4. Cashless Claim: The insurer will directly pay the repair
workshop upon completion of repairs and submission of
the repair tax invoice. The policyholder is responsible for
paying the difference between the insurer's liability and
the repair invoice.
5.Reimbursement Claim: If using a non-network garage,
the insurer will reimburse the claim amount according to
policy terms upon submission of the tax invoice and
payment receipt.
6.Invoice Requirements: For both cashless and
reimbursement claims, the tax invoice should be issued in
the name of "Bajaj Allianz General Insurance Company
Limited" and must include the GSTN of the respective
claim servicing office and state.

15 Obligations of the The approval or denial of your motor insurance claim is NA
Policyholder guided by key principles. For example, you must have
insurable interest-meaning the incident must involve your
insured vehicle, registered in your name, and covered
under your policy. You are required to act in utmost good
faith by providing accurate information and following
policy rules, such as reporting the loss occurrence
promptly. The claim must directly result from a covered
event (proximate cause), and you'll need to provide the
necessary evidence to receive compensation (indemnity).
Additionally, you have a duty of care and loss
minimization-you should take reasonable steps to prevent
further damage to your vehicle after an incident. Claims
may be denied if the damage results from wilful
negligence, such as leaving your car unlocked in an
unsafe area. If a third party is involved, especially in cases
of bodily injury or property damage, you must report the
loss to the police. Lastly, ensure that you report the claim
within the specified time frame. These principles help
ensure your claim is processed fairly and in line with your
policy.
Forward any claim letters, legal notices, court summons
etc. received by the insured to the insurance company
immediately.
Provisions of the Motor Vehicles Act, 1988:
Section 5: Responsibility of owners of motor vehicles for
contravention of sections 3 and 4.
No owner or person in charge of a motor vehicle shall
cause or permit any person who does not satisfy the
provisions of section 3 or section 4 to drive the vehicle.
Section 3: Necessity for driving licence.
(1) No person shall drive a motor vehicle in any public
place unless he holds an effective driving licence issued
to him authorising him to drive the vehicle; and no person
shall so drive a transport vehicle [other than 4[a motor cab
or motor cycle] hired for his own use or rented under any
scheme made under sub-section (2) of section 75] unless
his driving licence specifically entitles him so to do.
(2) The conditions subject to which sub-section (1) shall
not apply to a person receiving instructions in driving a
motor vehicle shall be such as may be prescribed by the
Central Government.
Section 4: Age limit in connection with driving of motor
vehicles.
1) No person under the age of eighteen years shall drive a
motor vehicle in any public place:Provided that 5[a motor
cycle with engine capacity not exceeding 50cc] may be
driven in a public place by a person after attaining the age
of sixteen years.
(2) Subject to the provisions of section 18, no person
under the age of twenty years shall drive a transport
vehicle in any public place.
3) No learner's licence or driving licence shall be issued to
any person to drive a vehicle of the class to which he has
made an application unless he is eligible to drive that
class of vehicle under this section.
Section 134: Duty of driver in case of accident and injury
to a person.
When any person is injured or any property of a third party
is damaged, as a result of an accident in which a motor
vehicle is involved, the driver of the vehicle or other person
in charge of the vehicle shall-
a) unless it is not practicable to do so on account of mob
fury or any other reason beyond his control, take all
reasonable steps to secure medical attention for the
injured person, 1[by conveying him to the nearest medical
practitioner or hospital, and it shall be the duty of every
registered medical practitioner or the doctor on the duty in
the hospital immediately to attend to the injured person
and render medical aid or treatment without waiting for
any procedural formalities], unless the injured person or
his guardian, in case he is a minor, desires otherwise;
(b) give on demand by a police officer any information
required by him, or, if no police officer is present, report
the circumstances of the occurrence, including the
circumstances, if any, for not taking reasonable steps to
secure medical attention as required under clause (a), at
the nearest police station as soon as possible, and in any
case within twenty-four hours of the occurrence.
(c) give the following information in writing to the insurer,
who has issued the certificates of insurance, about the
occurrence of the accident, namely:-

(i) insurance policy number and period of its validity;


(ii) date, time and place of accident;
(iii) particulars of the persons injured or killed in the
accident;
(iv) name of the driver and the particulars of his driving
licence.
Explanation. - For the purposes of this section, the
expression "driver" includes the owner of the vehicle.
