Sir,
1. Please refer to Applications for Joint Option Applicationof above pensioners
having Acknowledgement No. mentioned in the subject cited above. After
scrutiny of the application of above member as per Hon'ble Supreme Court
Judgement dated 04.11.2022 in the matter of Special Leave Petition (C) Nos.
8658-8659 of 2019 and EPFO Head Office circulars dated 29/12/2022 and
23/04/2023, this office had issued a letter dated 22.08.2023 seeking
clarification on points mentioned in the above said letter. Some of the major
issues highlighted in the applications are as follow: -
(1) The applicant/employer(s) has NOT_furnished proof of remittance of
contribution in EPF above wage ceiling along with online application
and the same is also not available for complete period in our
system/records.
(2) The applicant had NOT exercised Joint Option u/P 11(3) of pre
amended EPS, 1995 while being its member before 01.09.2014. NO
such proof is attached with online application.
(3) The employer(s) has NOT furnished complete wage details as it has
rejected the application.
2. After scrutiny of the applications, it was observed that the employer had
approved applications of aforementioned pensioners without submitting
requisite documents. However, following relevant rules, one month time was
initially granted to pensioners andestablishment to submit clarificationon the
issues pointed out in this office letter dated 22.08.2023. In response the
establishment submitted its clarification vide letter dated 07.03.2025,.
3. It is noteworthyto mention that M/s Burhanpur Tapti Mills was an exempted
establishment till 31.04.2004. Further, Amended rule 3(3) of Trust rules does
not allow contribution on wages exceeding ceiling limit.
4. In the light of aforesaid facts and Hon'ble Supreme Court judgement dated
23.04.2023,
04.11.2022 and EPFO Head Office circular dated 29.12.2022 and
