SALE OF LAND AGREEMENT

The agreement is made this day 11th APRIL 2023 between ERASTO OKUMU OWICH of ID/NO
2773429 of P.O. BOX, 7 RONGO herein referred to as the” VENDOR ‘’whose expression shall
where the context so admit to include their assigns, hers or any other person claiming their name
on the other part and ELLY OPIYO KEPHER ID/NO 12597631 of P.O BOX 7 RONGO herein
referred to as the ‘’PURCHASER’’ whose expression shall where the context so admits assigns,
hers or any other person claiming under their name on the other part.

IN WHEREAS it is agreed between the two parties as follows:

1. That the parties have mutually agreed on the aforesaid sale consideration.

2. The land be sold and bought at KENYA SHILLINGS SEVENTY THOUSAND ONLY
(kshs.70,000]

3. That ERASTO OKUMU OWICH is the registered proprietor of land parcels no


KAMAGAMBO/KANYAMAMBA/953 measuring approximately 0.075HA

4. That the VENDOR mentioned above is desirous to sub-divide and transfer part of the land
measuring approximately 0.17HA of the mentioned parcel to the buyer and the buyer is willing
to buy the same at a consideration cost of KENYA SHILLINGS SEVENTY THOUSAND
ONLY [KSH.70,000].

5.To date the PURCHASER pays KENYA SHILLINGS THIRTY NINE THOUSAND
THOUSAND ONLY (KSHS.39,000) to the vendor under which is to sign this agreement and he
acknowledges its receipt therefore the remaining balance is KENYA SHILLINGS THIRTY
ONE THOUSAND ONLY[kshs 31,000] to be paid upon transfer.

6. That the vendor undertakes to sign all manner of documents relevant to transfer of the said
land parcel number KAMAGAMBO/KANYAMAMBA/953 to the PURCHASER without any
encumbrances.

7.In the event of any default by either party in completion of transfer or fulfilling any of the said
above conditions the defaulting party shall apart from indemnify the innocent party as the
circumstances may then reasonably require either before the transfer or after the transfer be
further liable to pay the innocent party 30% of the consideration as liquidated damages for
breach of this agreement and should the party in breach be the vendor he or she shall in addition
refund all the monies already paid to him interest thereon at commercial rate.

This agreement is signed by the parties here to the day and year written above.
