RESOLUTION NO. LLLTO

WHEREAS, the Commission on Elections ICOMELEC) promulgated


Resolution No. 11135 on 23 April 2025 entitled "Guidelines on the Deployment of
the Philippine Nationql Police and the Armed Forces of the Philippines Personnel as
Special Electoral Boardforthe 12 May 2025 National and Local Elections";

WHEREAS, Republic Act No. 727231amended Section 13, Article XVI, of
Republic Act No. t70542, rescheduling the Bangsamoro Autonomous Region in
Muslim Mindanao Parliamentary Elections (BPEJ to 13 October 2025;

WHEREAS, the Gun Ban and Security Concerns Committee: [GSC)


issued a Memorandum4 to the Law Department dated 04 June 2025 which
provides for the Study on the utilization of Philippine Coast Guard (PCGJ
Servicemen and Auxiliaries, and Armed Forces of the Philippines Reservists
as Members of Special Electoral Boards;

WHEREAS, the Law Department issued Memorandum No.25-\7572


which provides that PCG servicemen and its auxiliaries may be appointed as
members of the Special Electoral Boards, since the exclusion as laid down in
Section 3(bl(21 and (d) of Republic Act No. 70756s does not apply to them;

NOW, THEREFORE, pursuant to the powers vested the in it by


Constitution, the Omnibus Election Code, Republic Act No. 7166, and other
election laws, the COMELEC RESOLVED, as it hereby RESOLVES, to
ADOPT Resolution No. 111.35 promulgated on 23 April 2025 and to
include the PCG personnel as Special Electoral Board forthe purpose ofthe
13 October 2025 BPE, with following amendments:

1,) Any and all references to "May 72, 2025 National and Local
Elections and BARMM Parliamentary Elections" and "2025
National and Local Electiotts" are to be read and understood as
referring to "October 73,2025 BPE".

2.) Sections 7,3,5, 6,7, 8 and 9 is amended to read as follows:

"SECTI0N 1. General Guidelines- The Commission will deploy


members of the PNP, AFP and PCG to act as SEBs under the following
circumstances:

Amended, Otherwise Known as the "Organic Law for the Bangsamoro Autonomous Region in
Muslim Mindanao", approved: 19 February 2025.

2An Act Providing for the Organic Law for the Bangsamoro Autonomous Region in Muslim
Mindanao, repealing for the Purpose Republic Act No. 6734, Entitled "An Act Providing for An
Organic Act for the Autonomous Region in Muslim Mindanao," As Amended by Republic Act No.
9054, Entitled "An Act to Strengthen and Expand the Organic Act for the Autonomous Region in
Muslim Mindanao", Approved: 27 luly 207A.

1.That the peace and order situation in the area requires the
deployment of PNP, AFP and PCG personnel to serve as SEB as
determined by the C0MELEC;

2.That the deployment of PNP, AFP and PCG as SEB shall be


under the operational command and control of the COMELEC;

3. That there are no other qualified, willing and available persons to


render election service in the affected area based on the certification
issued by concerned officials as mentioned in Section 14 (Order of
Preference), COMELEC Resolution No. 11100; and

4.That the area is categorized as RED Election Area of Concern


and/or declared under COMELEC Control;

SECTI0N 3. Qualification - The following are the


considerations in selecting the PNP, AFP and PCG personnel who
will act as SEBs:
1. Of good moral character and irreproachable reputation;

2. Of known integrity and competence;

3.Has never been convicted of any election offense or of any


crime punishable by more than six [6J months of imprisonment,
or has no pending Information of any election offense; and

4. Able to speak and write Filipino, English, or the local dialect.

SECTION 5. Consideration in the Area for Deployment The -


following factors shall be considered in the deployment of PNP,
AFP and PCG SEB:

t. That the members of the SEB for deployment in the


Bangsamoro Autonomous Region in Muslim Mindanao (BARMMJ
shall not come from the same region, province, city or
municipality, except as reserve SEB;

2.That the members of the SEB that will be deployed in Regions


other than BARMM, may come from the same region, province,
city or municipality where they are assigned as PNP, AFP and
PCG personnel;

3.That at least one (1] of the three (3) SEB underwent training, IT-
capable and is certified by the Department of Science and
Technology (DOST);

Specific deployment of trained SEBs shall be approved by the


Commissioner-in-Charge of the Gun Ban and Security Concerns
Committee [GSCJ.

SECTION 6. Issuance of Appointment - Appointment of PNP, AFP


and PCG SEBs, Supervising Official and Support Staff shall
immediately be issued by the Election Officer of the Municipality
where they are assigned.

SECTION 7. Exemption from the Ban on Transfer - To facilitate the


immediate mobilization of the PNP, AFP and PCG personnel as SEB,
including those from the Special Action Force (SAFJ of the PNP
who will be deployed for security and peacekeeping purposes, their
transfer shall be exempted from the prohibition on the transfer of
officers and employees in the civil service during the election period,
fromAugust 74,2025 to October 28,2025.

SECTION 8. Hierarchy of Authority - In the performance of their


poll- related duties, PNP, AFP and PCG personnel shall report to,
seek guidance, and follow the directives and instructions of the
Election Officer in the locality where they are assigned.

In the performance of their security, law enforcement and public


safety operations, the PNP, AFP and PCG personnel shall take and
follow instructions, directives and orders from their Chief of Police /
Team Leaders.

SECTI0N 9. Expenses - The PNP, AFP and PCG shall allocate


funds for the transportation, meals and other incidental expenses of
their personnel acting as SEB, chargeable against the Support Fund
provided by the Commission to these agencies.

RESOLVED, FINALLY that this Resolution shall take effect


immediately upon publication in two (2J newspapers of general circulation
and in the official website of the Commission.

The Education and Information Department and the Information


Technology Department shall cause the publication and posting of this
Resolution in two (2) newspapers of general circulation and in the official
website of the Commission, respectively.

The Education and Information Department is likewise directed to
furnish copies hereofto the Regional Election Director, Provincial Election
Supervisors, and Election Officers of BARMM, AFP, PNP, PCG, NICA, and all
other law enforcement agencies.
