Clerk: All rise! The Regional Trial Court of Sulu is now in session,
with the Honorable Judge Kyla Yasmine Ismaluddin presiding.

Judge Ismaluddin: You may be seated. We are here to deliberate


the case of Rebecca Jumadil versus Shirhana Aksa concerning the
alleged violation of the Patient’s Bill of Rights, specifically the first
right: "The right to be treated with respect." Court is now in session.
Prosecutors, you may proceed.
WITNESS TESTIMONIES

SCENE 2: WITNESS – Rebecca Jumadil (Mother)

Prosecutor Samsi:
We call Rebecca Jumadil to the witness stand.

Court Clerk Tiblan:

Rebecca: I, Rebecca Jumadil, Do solemly swear to tell the truth, the

Prosecutor Samsi: Can you state your name and what is your
connection to the late Mharouf Salibangsa

Rebecca: Ako po ang nanay ni Mharouf at nag-iisang kasama niya


sa bahay.

Prosecutor Samsi: Ma'am Rebecca, ano po ang eksaktong


nangyari nung araw nang June 1, 2025 na dinala niyo si Mharouf sa
Sulu Provincial Medical Center?

Rebecca: Umaga po iyon noong June 1, 2025. Sa bahay po panay


ang reklamo ng anak ko na sa masakit ang tiyan niya pero sinabi ko
na lang po na maalis din ito at pinakain at pina-inom ko na po siya
nagdadalawang isip po ako kung dadalhin ko siya sa ospital pero
wala po kaming sapat na pera pero nung humihiyaw sa sakit ang
anak ko. Dinala ko agad sa ER. Pero pagdating namin doon, ang una
nilang tinanong ay: “May pambayad ba kayo?” Sabi ko wala pa po,
emergency ito. Ang sagot nila: “Kailangan ng downpayment bago i-
admit.”

Prosecutor Samsi: Tumanggi silang gamutin ang anak mo dahil


lang sa pera?

Rebecca: Opo! Sinisigawan na ng anak ko, nagmamakaawa ako.


Pero wala silang ginawa. Hindi man lang nila nilapitan o tinignan.
Nilapitan ko po silang lahat nagmamakaawa na gamutin ang nag
iisa kong anak ngunit para silang mga bingi na tila walang naririnig
na nagsusumamo.

Defense Atty. Nasihul: Objection, Your Honor! The witness is


speculating the intentions of medical personnel.

Judge Ismaluddin: Overruled. She’s recounting her personal


experience. Proceed.
Prosecutor Samsi: Your Honor, I present to you Exhibit A: CCTV
footage showing Mrs. Jumadil crying in the emergency room where
her son is lying shouting of pain while staff ignore her son. Your
Honor, this is time-stamped 10:12 AM. I rest my case, Your Honor

Judge Ismaluddin: Exhibit A admitted into evidence. Defense


counsel you may cross examine

Defense Atty. Nasihul: Mrs. Jumadil, may posibilidad bang may


iba pang emergency na hinaharap ang mga staff noong oras na
iyon?

Rebecca: Emergency din ang anak ko! Kaya nga po kami sa ER


pumunta! Pero wala silang ginawa kahit nakita nilang halos
mawalan na ng malay ang anak ko!

Defense Atty. Nasihul: So wala kang alam sa internal protocols


ng ospital?

Rebecca: Wala, pero alam kong walang puso ang ginawa nila.

Defense Atty. Nasihul: That’s all, Your Honor

SCENE 3: WITNESS – Concern Nurse Farsha Asiri

Prosecutor Tampakan:
We call Farsha Asiri to the witness stand.

Court Clerk Tiblan:


Please raise your right hand. And repeat after me I state your name,
Do solemly swear to tell the truth, the whole truth, and nothing but
the truth so help me God.

Farsha: I, Farsha Asiri, Do solemly swear to tell the truth, the whole
truth, and nothing but the truth so help me God.

Prosecutor Tampakan: Can you state your name and what is your
connection to the late Mharouf Salibangsa

Farsha: I’am Farsha Asiri, a registered nurse and I was the one who
received the late Mharouf Salibangsa in the emergency room since I
was on the duty on June 1, 2025.

Prosecutor Tampakan: Nurse Farsha, can you describe the


patient’s condition on that day you received him.
Farsha: The patient is pale, sweating, curled in pain. When I took
his vital signs it showed tachycardia and low BP. I was alarmed by it
and I immediately reported it to Dr. Shirhana Aksa. Pero ang sabi
niya sa akin: “Wala pang bayad? Then no admission.”

Defense Atty. Hashim: Objection! Hearsay!

Prosecutor Tampakan: Direct quote, Your Honor. She personally


heard it.

Judge: Overruled.

Farsha: I tried to initiate IV fluids. I even prepped for OR, but was
stopped. I filed a nursing incident report.

Prosecutor Tampakan: To support the witness claims here is the


Exhibit B- containing the nursing incident report.

Judge: Admitted. Defense counsel you may cross examine.

Defense Atty. Hashim: Nurse Asiri, are you a licensed surgeon?

Farsha: No, but I know the protocols for pre-op. I escalated the
issue. But my hands were tied.

Defense Atty. Hashim: You did not force the OR because it wasn’t
your place?

Farsha: Correct. That decision was Dr. Aksa’s, and she chose not to
act.

Prosecutor Tampakan: So if Dr. Aksa gave the go signal, would


the surgery have been done?

Farsha: Absolutely. We were ready.

SCENE 3: WITNESS – Security Guard Jerrymie Madjid

Prosecutor Samsi:
We call Jerrymie Madjid to the witness stand.

Court Clerk Tiblan:


Please raise your right hand. And repeat after me I state your name,

Jerrymie: I, Jerrymie Madjid, Do solemly swear to tell the truth, the

Prosecutor Samsi: Can you state your name and what is your
connection to the late Mharouf Salibangsa

Jerrymie: Ako po si Jerrymie Madjid security guard po ako sa Sulu


Provincial Medical Center at sa araw po ng insidente ako po ay
naka-assign na magbantay sa emergency room.

Prosecutor Samsi: Mr. Madjid, can you tell us what exactly you
saw on the of the incident.

Jerrymie: Nakita ko pong umiiyak ang nanay, sumisigaw ang


pasyente. Ilang minuto ring walang lumapit. Si Nurse Farsha lang
ang gumagalaw. Yung iba, tumingin tapos umalis.

Defense Atty. Nasihul: Sa araw po ba na iyon busy po ba ang


emergency room?

Jerrymie: Opo, sobra. Ngunit nangingibabaw po ang sigaw ng


namatay at ang pagmamakaawa ni aling Rebecca.

Defense Atty. Nasihul: Did you see any physical harm done by Dr.
Aksa?

Jerrymie: Hindi, pero nakita ko siyang lumakad papalayo. Ni hindi


man lang tumingin sa pasyente.

Prosecutor Samsi: Would you say that ignoring an emergency is a


form of disrespect?

Jerrymie: Yes, sobra pa po. Sa mata ng isang ina, nakakabaliw


'yun.

SCENE 4: WITNESS – Radiologist Jascha Sarian

Prosecutor Tampakan:
We call Jascha Sarian to the witness stand.

Court Clerk Tiblan:

Jascha: I, Jascha Sarian, Do solemly swear to tell the truth, the


whole truth, and nothing but the truth so help me God.
Prosecutor Tampakan: Can you state your name and what is your
connection to the late Mharouf Salibangsa

Jascha: I’m Jascha Sarian, a registered radiologist. I was the


assigned to get ultrasound test for the late Mharouf Salibangsa
since it is protocol in the hospital once the patient is received
imeediate test is needed even without physicians order.

Prosecutor Tampakan: Ms. Sarian, what did your scan reveal?

Jascha: The ultrasound revealed inflamed appendix with free fluid


— this was about to rupture. And a sign of peritonitis. I rushed the
report to ER nurses. Here’s Exhibit C.

Prosecutor Tampakan: Your Honor, I present to you the Exhibit C-


the ultrasound result of the patient.

Judge Ismaluddin: Admitted.

Defense Atty. Hashim: Did you personally speak to Dr. Aksa?

Jascha: No. But the urgency was written all over the report. And the
ER nurses are the ones responsible to relay the results to the
physician.

Prosecutor Tampakan: What would be the result of ignoring this


scan?

Jascha: Peritonitis. Sepsis. Death.

Prosecutor Tampakan: That’s all, Your Honor

SCENE 5: WITNESS – Medical Technologist Khyla Sawadjaan

Prosecutor Samsi:
We call Khyla Sawadjaan to the witness stand.

Court Clerk Tiblan:


Please raise your right hand. And repeat after me I state your name,
Do solemly swear to tell the truth, the whole truth, and nothing but
the truth so help me God.

Khyla: I, Khyla Sawadjaan, Do solemly swear to tell the truth, the


whole truth, and nothing but the truth so help me God.

Prosecutor Samsi: Can you state your name and what is your
connection to the late Mharouf Salibangsa
Khyla: I’m Khyla Sawadjaan, a registered medical technologist of
Sulu Provincial Medical Center. And the one who examine the blood
samples of the late Mharouf Salibangsa.

Prosecutor Samsi: Ms. Sawadjaan, ano lumabas sa lab results?

Khyla: Elevated WBC, dropping hemoglobin. Infection progressing.


Emergency case. I labeled the file STAT.

Defense Atty. Nasihul: Did Dr. Aksa delay because she didn’t
receive the report?

Khyla: Hindi. Nakita ko pong dinala ng ER nurses sa physician’s


desk agad ang results. Walang aksyon. Exhibit D po, the lab sheet.

Prosecutor Samsi: Your Honor, I present to you Exhibit D- lab


results of the patient on the day of the incident

Judge: Admitted.

SCENE 6: WITNESS – Dr. Shirhana Aksa

Defense Atty. Hashim: Dr. Aksa, please explain your actions.

Dr. Aksa: I was handling another emergency. I was told the case
was stable. I did not refuse surgery; I was waiting for confirmation.

Prosecutor Tampakan: Did you say “No surgery without


payment”?

Dr. Aksa: I may have said we require payment, but—

Prosecutor Tampakan: Objection, Your Honor! She admits it!

Defense Atty. Nasihul: Objection! Misleading.

Judge Ismaluddin: Overruled. Continue.

Prosecutor Tampakan: You chose policy over life. Did you not
know about RA 10932?

Dr. Aksa: I do now, but at that time...

Prosecutor: So you ignored the law and let the child die?

Dr. Aksa: I did what I thought was standard.


Prosecutor Tampakan: And your inaction killed Mharouf.

SCENE 7: WITNESSES – Nurses Zareenah Dugasan, Sharamie


Hambali, Aljamar Makintan

Prosecutor Samsi: Nurses, did you see the patient in pain?

Zareenah: Yes, but we thought it was being handled.

Sharamie: We were short-staffed and prioritizing.

Aljamar: We followed protocol.

Prosecutor Samsi: Isn’t it protocol to respond to pain?

Zareenah: Yes...

Prosecutor Samsi: And you didn’t. Why?

Sharamie: We didn’t think it was urgent.

Prosecutor Samsi: And that mistake cost a life.

Defense Atty. Hashim: Objection! Argumentative!

Judge Ismaluddin: Sustained.

CLOSING ARGUMENTS

Prosecutor Tampakan:
This court heard the cries, not just of the mother, but from every
healthcare principle violated that day. RA 10932 was designed to
prevent exactly what happened here. Beyond policy, it is human
decency that was denied. Mharouf Salibangsa died not just from
illness—but from inaction. We ask this court to give justice to the
voiceless.

Defense Attorney Nasihul:


Tragedies reveal gaps, but not always guilt. Dr. Shirhana Aksa and
her team were constrained by system limitations. Yes, there were
delays, but no deliberate disrespect or intent to harm. Let us
improve the system, not unjustly condemn individuals within it.
VERDICT

Judge Ismaluddin:
After hearing the testimonies and reviewing the evidence, this court
finds that the hospital staff, particularly Dr. Shirhana Aksa and
supporting nurses, have violated Republic Act No. 10932, and
more importantly, the first right of the Patient’s Bill of Rights: the
right of the pateint to be treated with respect.

Their inaction, despite overwhelming medical indicators and pleas,


directly contributed to the preventable death of Mharouf Salibangsa.
The Anti-Hospital Deposit Law exists to protect lives. Any hospital
staff who violates this shall be held accountable.

The court hereby finds the defendants GUILTY of gross


negligence and violation of RA 10932. Administrative and
possible criminal charges will be recommended to the
proper medical board and Department of Health.

This court is adjourned.
