MEMORANDUM OF AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:
This Memorandum of Agreement, made and entered into this 6TH day of JANUARY
2024, by and between:
The BARANGAY LUMBAAN-BICBICA COUNCIL, with office address at Brgy.
Lumbaan-Bicbica, Pinili, Ilocos Norte, herein represented by its Punong Barangay, HON. FE
M. TIRO, hereinafter referred to as the FIRST PARTY.
-and-
The BICBICA PRIMARY SCHOOL, with office address at Brgy. Lumbaan-Bicbica,
Pinili, Ilocos Norte, herein represented by its Principal/School Head, MRS. JULIA
BALDOMIR, hereinafter referred to as the SECOND PARTY.
WHEREAS, in compliance with Section 2 (a) or Republic Act 10121 otherwise known as the
Philippine Disaster Risk Reduction and Management Act of 2010, there is a need to identify
and assign evacuation centers to be used during the occurrence of disaster/calamity;
WHEREAS, the parties understand that the government, citizens and non-governmental
organizations must coordinate in an effort to make the best use of limited resources and
avoid duplication of services;
WHEREAS, this understanding aims to have zero casualty and no injury in times of disaster,
strengthen stakeholders to become knowledgeable to all forms of hazards in the barangay,
and dynamically work towards the safety of the residents and to make disaster risk
management become priority.
WHEREFORE, in view of the foregoing premises, the FIRST PARTY and the SECOND
PARTY hereby agree upon the following undertakings:
ARTICLE I: PURPOSE
This agreement provides a framework within which the Barangay Lumbaan-Bicbica
Council and Bicbica Primary School will cooperate with each other to carry out the respective
responsibilities for designated evacuation areas in times of disaster.
ARTICLE II: INTRAGEMCY COMMUNICATIONS
To provide for consistent and effective communication between the Barangay
Lumbaan-Bicbica Council and Bicbica Primary School, each party shall appoint a Principal
Representative to serve as its central point of contact of matters relating to this Agreement.
ARTICLE III: DUTIES AND RESPONSIBILITIES
A. The Barangay Lumbaan-Bicbica Council agrees to:
a. Include Bicbica Primary School in catastrophic
planning that endeavors to include all sectors of the whole community
emphasizing realistic planning for the potential to extraordinary challenging
and complex disaster scenarios, as appropriate;
b. Notify the Bicbica Primary School upon the threat of a disaster or
emergency, or upon the occurrence of a disaster or emergency, of the
determination by the Barangay Council of a need for mass care operations,
and coordinate with them for disaster preparedness;
c. Review supply reports to monitor availability of supplies and to coordinate
with Bicbica Primary School to resolve problems or issues as they arise;
d. Respect Bicbica Primary School chain of command and work directly
through those established protocols to effect a coordinated response to the
disaster.
B. The SECOND PARTY agrees that the Bicbica Primary School, and its premises be
designated as an alternative evacuation center during and/or after a disaster or
emergency as needed. In order to accomplish this, and in coordination with
Barangay Lumbaan-Bicbica council, the party will:
a. Participate in pre-incident planning with other private and/or public agencies
regarding the provision of mass care services during a crisis or emergency;
b. Coordinate with Barangay Lumbaan-Bicbica Council of the needed supplies
for mass care operations;
c. Immediately provide information on goods availability for proper control of
available resources.
ARTICLE IV: OTHER PROVISIONS
A. Notwithstanding anything to the contrary, each party shall have exclusive authority
to direct its employee and implement its own statutory responsibilities.
B. Nothing in this agreement is intended to conflict with current state law. If a
provision of this agreement is inconsistent with such authority, then that provision
shall be invalid, but the remaining provisions and conditions of this agreement shall
remain in full force and effect.
ARTICLE V: MODIFICATION
This MOA may be modified upon the mutual, written consent of the parties.
ARTICLE VI: EFFECTIVE DATE
The terms of this MOA will become effective on the date of the last signature by the
parties.
IN WITNESS, WHEREOF, parties have affixed their signature this 5 th Day of May, 2023 at
Pinili, Ilocos Norte, Philippines.
