MOOT PROPOSITION
1. Aarav Oberoi, aged 34, hailed from a reputed business family of Bangalore.
His early life was overshadowed by tragedy, as he lost both his parents in a
devastating car accident during childhood. Thereafter, he was raised by his
maternal aunt, Siddhi Malhotra, who provided him with affection and guidance.
However, the emotional vacuum created by the loss of his parents had a lasting
impact on his psyche. In his college years, Aarav struggled with depression, drug
addiction, and suicidal tendencies. With timely intervention from his aunt and
after multiple sessions in rehabilitation centres, he eventually recovered.
Choosing to rebuild his life with determination, Aarav pursued an engineering
degree and secured employment at Tech-Fusion Innovations, one of Bangalore’s
leading companies in artificial intelligence and robotics. This marked a turning
point, giving him professional stability and a new sense of direction.
2. In contrast, Selena Luthra, aged 30, was born into wealth and influence as the
daughter of industrialist Albert Luthra. She enjoyed a privileged upbringing, with
access to elite education and luxuries of life. Academically accomplished, she held
degrees in finance, MBA, and AI engineering, and worked with her father’s
company in Bangalore. However, her indulgent lifestyle and materialistic outlook
shaped her personal choices. From a young age, Selena had been accustomed to
extravagance and often entered into relationships based on financial security
rather than genuine emotional connection.
3. Aarav and Selena’s paths crossed at a high-profile corporate conference. Their
initial interactions were professional, yet gradually developed into personal
companionship. While affection was present, their relationship was driven more
by convenience and social advantage than love. After a brief courtship, they
married on 25 February 2019 in Bangalore.
4. Marital discord surfaced soon after the wedding. Aarav’s demanding
professional life left Selena feeling neglected. Matters deteriorated when
unverified rumors reached her that Aarav was engaging in extramarital affairs
while she was away. Trust eroded rapidly, and the couple’s relationship became
toxic.
MOOT PROPOSITION
5. Their home turned into a battleground of frequent quarrels, verbal
abuse, and on occasions, physical violence. Selena, accustomed to
authority and affluence, often belittled Aarav by reminding him of his
tragic past. This deeply affected his mental health, pushing him again into
depression. Struggling to cope, Aarav turned to alcohol and returned
home intoxicated on several occasions, further straining their
relationship.
6. The situation reached breaking point on 4 October 2022, when Selena
left their matrimonial home and shifted to her flat in Bombay. It was
during this time that Aarav, while clearing their wardrobe, discovered
medical reports Selena had inadvertently left behind. One report, dated 3
March 2018, revealed that Selena had undergone an abortion before
marriage with her ex-boyfriend’s child. Another report, dated 23 August
2022, showed that she was six weeks pregnant, a fact she had concealed
from him. These revelations came as a shock, but Aarav had by then
grown emotionally detached.
7. Albert Luthra, father of Selena, intervened, seeking reconciliation. His
motivation, however, was not rooted in concern for his daughter’s
wellbeing, but rather in preserving the family’s reputation and shielding
it from scandal. Despite his anguish, Aarav decided to accept Selena back
into his life. His reasoning was shaped by compassion towards the unborn
child, who, in his view, should not suffer for the mistakes of parents. Thus,
reconciliation was effected, and marital life resumed.
8. For a brief period, there was calm. Their relationship appeared to
stabilize, and Aarav took on the financial responsibility of supporting his
wife and her family. In January 2023, he transferred ₹13 lakhs to his
mother-in-law and brother-in-law through IDBI and Bandhan Bank
accounts. On 20 March 2023, Selena gave birth to a baby girl. Aarav
embraced fatherhood with sincerity, resolving to provide a safe and
nurturing environment for the child.
MOOT PROPOSITION
9. However, peace was short-lived. Selena soon returned to her previous
patterns of disinterest and detachment. She began to spend extended
periods in her Bombay flat without informing Aarav of her whereabouts.
Her approach towards Aarav remained transactional, treating him more
as a financial provider than a partner. Her continuous demands for a
lavish lifestyle placed Aarav under severe financial stress, as his
resources could no longer keep up with her extravagant expectations.
10. On 6 January 2024, Selena filed an FIR against Aarav, alleging
domestic violence, dowry harassment under Section 498A of the Indian
Penal Code, unnatural sexual acts under Section 377 IPC, grievous hurt,
and criminal intimidation. Aarav categorically denied all allegations,
terming them fabricated and motivated by malice. He maintained that
no credible evidence existed to substantiate the charges.
11. Further, on 11 January 2024, Selena filed a divorce petition under
Section 13(1)(ia) of the Hindu Marriage Act, citing cruelty as the ground.
Surprisingly, four months later, she withdrew the petition, raising
questions about her true intentions. Yet, she did not desist from
litigation. On 10 June 2024, she instituted proceedings under Section 125
of the Code of Criminal Procedure, 1973, seeking ₹2,00,000 per month as
maintenance. After hearing both parties, the Court awarded her ₹80,000
per month. Aarav, already financially constrained, argued that he was
incapable of paying such an amount, but the order was passed
nevertheless.
12. During subsequent proceedings, Aarav challenged the jurisdiction of
the case under Section 145 of the Bharatiya Nagarik Suraksha Sanhita,
2023. However, the pressures of litigation, coupled with financial strain
and emotional harassment, worsened his fragile mental health. Multiple
court-directed mediation sessions failed to yield resolution.
MOOT PROPOSITION
13. On 20 November 2024, Aarav, unable to endure further humiliation
and despair, recorded a 1.5-hour video statement, uploaded on
SnapGram and left behind a suicide note(attached at annexure). In both,
he detailed the harassment and false accusations he allegedly suffered at
the hands of Selena and her family. Later that night, he took his own life.
On 21 November 2024, his lifeless body was discovered in his Bangalore
residence.
14. Following his death, the police registered a case against Selena and
her family under Section 108 read with Section 3(5) of the Bharatiya
Nyaya Sanhita, 2023, charging them with abetment of suicide. The matter
went to trial before the Sessions Court, which initially acquitted all
accused on the ground of insufficient evidence. Dissatisfied, the State
preferred an appeal before the High Court. Upon re-examination of the
evidence, the High Court overturned the acquittal, holding Selena and
her family guilty. They were sentenced to 10 years of rigorous
imprisonment and fined ₹10,00,000.
15. Aggrieved, Selena filed a Special Leave Petition (SLP) before the
Hon’ble Supreme Court of India, where the matter presently remains
pending adjudication.
ISSUES
Issue no. 1. Whether the present SLP is maintainable?
Issue no. 2. Whether Selena and her family can be held
liable for the offence of ‘abetment of suicide’?
Issue no. 3. Whether the Suicide note of the deceased is
sufficient to form the sole basis for conviction?
Issue no. 4. Whether the video uploaded on SnapGram by
the deceased can be considered as a Dying Declaration?
SUICIDE NOTE (Annexure)
My marital life with Selena Luthra has been a journey marked by immense
challenges and emotional distress. When we married on February 25, 2019, I
hoped for a partnership built on mutual respect and understanding.
Unfortunately, it soon became evident that our relationship was strained by
differences in expectations and priorities. Selena, accustomed to a life of
luxury, often belittled me for my modest background and financial limitations.
Her taunts about my inability to save my parents during their tragic accident
cut deeply. The emotional strain from her remarks, coupled with the constant
conflicts, became unbearable. Our disagreements escalated to physical
altercations, leaving me emotionally drained and seeking refuge in alcohol to
cope with the toxic environment. Despite these struggles, I made significant
financial sacrifices to support Selena and her family, including transferring
₹13 lakhs to her mother and brother. However, these efforts were not enough
to satisfy her lavish expectations She filed for maintenance under Section 125
of the Code of Criminal Procedure, demanding ₹2,00,000 per month despite
knowing my financial constraints. The court eventually ordered me to pay
₹80,000 per month—a sum that far exceeded my earnings and plunged me
into financial distress. Selena’s claims of my extramarital affairs and financial
mismanagement were baseless and deeply hurtful. Despite my best efforts to
provide for my family and reconcile for the sake of our child, the relentless
accusations and legal battles left me feeling helpless and despondent. Selena
underreported her own income to strengthen her case added to my
frustration, as did the repeated mediation attempts, which seemed designed to
exhaust me financially and emotionally. Now I am gone, there will not be any
money to loot. I am tired of this harassment. All my case hearings should
happen live and the people of this country should know about my case and
learn the terrible state of the legal system and misuse of law these women are
doing. Give the custody of my child to my aunt who can raise her with better
values. Give maximum punishment to my harassers though I don’t trust the
legal system now. If people like my wife are not put behind Jail, they will be
more emboldened and will put more false cases on other sons of the society in
the future. As suggested by my wife Selena Luthra and the laughing of the
Judge on instigation that I should commit suicide. This suicide is going to stop
the supply of money to my enemies and corrupt the legal system. I choose to
commit suicide today which seems to be the best option.
