MEMORANDUM OF THE DEPOSIT OF TITLE DEEDS

THIS MEMORANDUM OF DEPOSIT OF TITLE DEEDS is executed at Saharanpur on this 07-08-2025 By and Between

Mr. Naime (Aadhar card no. 9422 1294 6412 ) S/o Ikhlas , Aged about-41 years, R/o- NEAR RUHDWE KA PUL
KANOONGOYAN NANAUTA DEHAT Distt Saharanpur, PIN Code.-247452. Hereinafter called as the “Mortgagor”
which term shall always mean and include his legal heirs, executors, agents, administrators, successor-in-office and
assigns) of the ONE PART: Mobile No.

TO AND IN FAVOUR OF

Shriram Finance Ltd., a Company registered under the Companies Act,1956 and having its registered office at
123,Anagappa Naicken Street,Chennai,Tamil Nadu-600001 and one of its branch office situated at 1st FLOOR
MOGHA COMPLAX ABOVE IDBI BANK DELHI ROAD,City-SAHARANPUR, PIN Code-247001 Tehsil & Dist-SAHARANPUR
Having PAN -AAACS7703H represented by its authorized signatory Mr.Lakhan Singh( Aadhar card no.
686330937385) S/o Mr.Pratap singh , Aged 29 Years, Occu.-Service, Having Pan No. HCXPS6358R , R/o Samanpur
shikarpur , bulandshahr UP (Hereinafter called as the “Mortgagee”” which expression shall unless, the context
otherwise requires include its successors and assigns) of the OTHER PART.

WHEREAS the Mortgagor herein is the absolute Owner and possessor of the property situated at House no-5/486,
Khasra no-1025, at Mohalla-Kanoongoyan, Town-Nanauta, Pargana-Rampur, Tehsil-Rampur Maniharan, Distt.
Saharanpur. Property area is 198.64 square meters. which is more fully described in the Schedule “A” hereunder,
and;
1. WHEREAS the Mortgagor represents that he is the absolute Owner and possessor of the Schedule A property
which is belongs to him and its not the subject matter of any dispute, subsisting agreement of sale, mortgage,
charge, lien, lispendence or any other encumbrances whatsoever, and;
2. WHEREAS the Mortgagor also represents that he is fully competent to execute this deed, and he is the absolute
owner and seized and possessed of immovable property more particularly described in the Schedule “A”
hereunder written, and hereinafter referred to as the “Schedule “A” property”.
AND WHEREAS Mr. NAIME, ( Borrower/Guarantor) Mortgagor herein approached Shriram Finance Ltd (herein after
referred as Mortgagee) and requested to sanction loan amount of Rs.7,00,000/- for expansion of his Business. In
view of granting Business loan amount by Mortgagee, Mortgagor agreed to deposit the schedule “A” property to
mortgage and create an Equitable Mortgage by way of depositing of all title deeds pertaining to Schedule “A”
property towards securing the repayment of the loan.

in consideration of Mortgagee advancing /agreeing to provide the Loan to the Mortgagor, the Mortgagor has
agreed to create an Equitable Mortgage by deposit of title deeds in favour of and for the benefit of the Mortgagee
in the Schedule “A” Property to secure the repayment of the above said loan to be granted by the Mortgagee
together with interest(s),costs, other charges and also for all other liability inclusive of interest etc., whatsoever
becoming due under or in relation to the above said loan.

AND WHEREAS, the title deeds pertaining to the Schedule “A” property is more fully described in the Schedule “B”
hereunder;

AND WHEREAS the Mortgagor has agreed to execute this Memorandum of Deposit of Title Deed in relation to the
Schedule “A” Property;
NOW THIS MEMORANDUM RELATING TO DEPOSIT OF TITLE WITNESSETH AS UNDER:

1. The Mortgagor dated 06-08-2025 deposited with the Mortgagee at SAHARANPUR(Branch),the title deeds,
documents and writings described in Schedule “B” hereunder written, pertaining to the Schedule “A”
property (more particularly described in Schedule-A) as and by way of equitable mortgage with an intent to
create mortgage and charge over the Schedule-A property together with the buildings and other
structures, fixtures and fittings constructed, erected, or installed or which may be constructed or erected
thereon.
2. The Title Deed, more particularly described in Schedule-B shall be held by Mortgagee as a security for
repayment of the said Loan of Rs. 7,00,000 (Seven Lakh Rupees) advanced/and or to be advanced by the
Mortgagee to the Mortgagor together with interest(s), costs and other charges and also for all other
indebtedness and liability whatsoever in relation to the above said loan.
3. The Mortgagor declares that the Title Deeds, documents and writings deposited with the Mortgagee are
the only documents that are in his possession and custody and that the Schedule “A” Property shall remain
as security till the entire loan amount of the said loan inclusive of all interest, cost, charges and expenses
incidental thereto are fully repaid to the Mortgagee by the Mortgagor.
4. The Mortgagor declare that he is fully seized and possessed of and well sufficiently entitled to the Schedule
“A” property and that there is no mortgage, charges, lien, encumbrances or attachment of whatsoever
nature in relation to the Schedule “A” Property.
5. That the Mortgagor has not created or purported to create any license, charge, lease, mortgage or lien over
the Schedule “A” Property or any other person has any right, title, interest, claim or demand interest in the
said “Schedule-A” Property either by way of Mortgage, gift, lease, charge or otherwise and there is no
pending litigation of any kind whatsoever. That the Mortgagor has not entered into any agreement for
alienation in relation to the said Schedule “A” Property or part thereof. Henceforth, the Mortgagor shall not
enter into any agreement/Mortgage with any third party for creating any rights of whatsoever nature of the
“Schedule-A” property until and unless the entire mortgage debt is paid to the Mortgagee in full.
6. The Mortgagor confirms and declare that he has full power and absolute authority to in its own right to
mortgage the Schedule “A” property and /or to create security in favour of the Mortgagee and executed
this Memorandum.
7. That the Mortgagor shall not do or cause to be done or omit it do any act, deed, matter or thing whether or
by reason whereof the Security of the Mortgage by deposit of title deed of the Schedule “A” property is
jeopardized.
8. The Original title documents of the Schedule “A” property were handed over and deposited with (Mr.
LAKHAN SINGH (EMP CODE L-264) Shriram Finance Limited SAHARANPUR who is the authorized
representative of the Mortgagee with intent to create security by way of Equitable Mortgage.

SCHEDULE “A” PROPERTY


A Residential House, South facing, admeasuring total area of 198.64 square meters, Situated in the part of House

no-5/486Khasra no-1025, at Mohalla-Kanoongoyan, Town-Nanauta, Pargana-Rampur, Tehsil-Rampur


Maniharan, Distt. Saharanpur, and situated within the local limits of Nagar Panchayat, Nanauta, which is
bounded by towards: -

On the East : House of Valeem;


On the West : Property of Babu;
On the North : House of Abdul Wahab & others;
On the South : Rasta 14 feet or 4.27 meter wide.

1. Original Gift Deed with certified copy Doc No-6311/2024 dated 20-07-2024, executed by Mohd.
Ikhlash to Mr. Naime.
2. Certified copy of Assessments of property from year 2014 to 2024, situated in Mohalla-Kanoongoyan, Town-
Nanauta, Pargana-Rampur, Tehsil-Rampur Maniharan, Distt. Saharanpur..
3. Copy of House tax bill in favor of Naime.
4. Copy of Electricity bill in favour of Mr. Naime
5. Self Attested Aadhar card Mortgagee & Witness.
6. Affidavit cum Under Taking.
