UNSTAR TENDER NOTICE

The Municipal Corporation of Greater Mumbai invites the online Unstar tender
on percentage rate basis for the work of “Providing & fixing of compound gate near staff
quarter, repairs to Labour rest room & general repair works in charkop pumping
station under the jurisdiction Ch. Engg (S.O)”.
All interested vendors/contractors, whether already registered or not registered in
MCGM, are mandated to get registered with MCGM for e-Tendering process, Login
Credentials to participate in the Online bidding process on the above-mentioned portal
under “e-Procurement ” tab.
For registration, enrollment for digital signature certificates & user manual, please
refer to respective links provided in e-Tendering tab. The vendors/contractors can get
digital signature from any one of Certifying authorities (CA’s) licensed by the Controller of
Certifying Authorities, namely Safes crypt, IDRBT, National Informatics Centre, TCS,
Customs, MTNL, GNFC and e-Mudhra CA.

months time period from the award of contract,
otherwise their EMD & ASD shall be forfeited &
the award of the contract will be treated as
cancelled.

Bid capacity criteria for bidders for quoting works in e quotation or unstar
tenders :-
The bidder shall note and ensure that they are eligible for the bid as per following
table. If any bidder is found non responsive due to non confirming of bid criteria, their
EMD will be forfeited.

If any Enquiry against the tenderer, registered in M.C.G.M./Semi Govt./ Govt.
Organization, is initiated/pending, then the Unstar Tender of that tenderer will be treated
as Non-Responsive.
The Unstar Tender should be submitted online upto 15:00 P.M. on 28.04.2022
by e-tender process. The Financial e-Packet of the e-Tenderers will be opened after 3pm
on the next working day after the end date of e-tender.
After opening of online financial bid, if it is observed that the lowest bidder has
quoted percentage more than 15% and above or below the estimated cost then rate
analysis in USOR format shall be called by the department through email from such bidder.
Such rate analysis shall be submitted by the contractor within 3 working days from receipt
of e-mail from the department. Per day of delay in submission of rate analysis by the
bidder will entail penalty of 1% of EMD amount. If the rate analysis, as required, is not
submitted within 07 days of submission by the bidder OR if the lowest bidder backs out
from the tender award process, such bidder will be barred from participating in the tender
process of any department of MCGM for a period of 03 years from the date of opening of
Financial Packet.
If the rate analysis submitted by bidder is not workable, then penalty of
Rs. 5,000/- each for first three instances will be recovered from vendor registration
deposit or from his dues with MCGM. If continuation of such offences is observed, the
action of blacklisting the vendor shall be initiated.
The successful tenderer should submit affidavit on Rs. 500/- stamp paper stating
that they will submit valid insurance policy i.e. work contract policy, CAR policy and Janata
Policy in due course of time
After getting contract, if the requisite documents like performance guarantee,
affidavit, etc. are not submitted within three days, the offer of L-1 shall be treated as
cancelled. Further, their Security deposit shall be forfeited and they will be debarred from
bidding for next three years and the offer of L-2 shall be accepted.

Online EMD and ASD payment in e-quotation / unstar tendering:-
As per Circular under No. CA (F) / 42 dated 28.03.2018, Earnest Money Deposit and
Additional Security Deposit shall be paid online in the respective tab in e-tendering system
before submission of the bid. In e-quotation / unstar tendering Contract bidding, the
condition of online submission of EMD / ASD is mandatory.
Hence, bidder shall paid requisite ASD online as per formula given below:-
ASD=1 x ( X/100) x office estimated cost.
Where X = percentage rebate quoted on the office estimated cost by the tenderer
minus 12%.

The Bank Guarantee for Performance Guarantee will not be accepted in broken
period and same will be one complete Bank Guarantee for entire Defect Liability Period.
Security/Contract Deposit :
The successful tender, here after referred to as the contractor shall pay an amount
equal to two (2) percent of the contract sum in the form of bank guarantee valid up to
completion of defect liability period within 30 days from the date of receipt of letter of
acceptance. (As per circular No. CA (Finance) / Project / 36 dated 07.12.2020 )
Legal & Stationery Charges: As per circular No Law Dept./03 dtd 22.06.2021
Tax:- As per circular under No. CA / F/ Project / City / 28 Dated 10.11.2017.
G.S.T. and other state levies/cess which are not subsumed under GST will be
applicable. The tenderer shall quote inclusive of all taxes. It is clearly understood that
MCGM will not bear any additional liability towards payment of any Taxes & Duties.
Whenever the services to be provided by the Tenderers falls under Reverse Charge
Mechanisum, the price quoted shall be exclusive of GST, but inclusive of Taxes / Duties /
Cess other than GST, if any.
Rates accepted by MCGM shall hold good till completion of work and no additional
individual claim shall be admissible on account of fluctuations in market rates, increase in
taxes / ay other levies / tolls etc. except that payment / recovery for overall market
situation shall be made as per price variation.

As per circular under No. CA / F/ Project / City / 17 Dated 06.09.2017.
“ Chapter XXI- Miscellaneous, section 171(1) of GST Act, 2017 governs the ‘
Anti Profiteering Measure’ (APM)
As per provision of this section, ‘ Any reduction in rate of tax on any supply
of goods or services or the benefit of input tax credit shall be passed on to the recipient by
way of commensurate reduction in prices’.
Accordingly, the contractor should pass on the complete benefit accruing to him on
account of reduced tax rate or additional input tax credit, to MCGM.
Further, all the provisions of GST Act will be applicable to the tender”.
The bidder shall submit ‘Annexure A’, Irrevocable Undertaking on Rs. 500/-
stamp paper as per Circular under No. CA / F / Project / 19 dated 15.09.2017 as per
below format;

and is discovered at any later stage, MCGM shall be at liberty to initiate legal action against me
for its recovery including, but not limited to, an appeal to the Screening Committee of the GST
Counsel.

company / other Directiors of the company and also upon my / our legal heirs, assignee,
Executor, administrator etc.
4) If I fail to compliance with the provisions of the GST Act, I shall be liable for penalty
/ punishment or both as per the provisions of GST Act.

Scope of the Work includes following activities:-
1) Providing & fixing of M.S.gates in pumping premises.
2) Repairing of labours rest room including replacement of roof, Replacement of
doors and windows and W.C pan ,skirting ,dado , Colouring work & other
works.
3) Providing of grills to pumping station, repairing of toilet ,bathrooms & other
work.
The dates and time for submission and opening the e-tenders will be displayed on
the MCGM Portal. (http://portal.mcgm.gov.in).
The Specifications of works can be downloaded from MCGM’s portal
(http://portal.mcgm.gov.in).
Bidders are requested to refer Circular Nos. Director (IT)/F-302 dated 22-12-2014
and Dir.(ES&P)/3201/II dated 07-09-2015 for further details.
The Municipal Commissioner reserves the right to reject any or all e-tenders
without giving any reason to the e-renderers.
