Ernest Soon filed a petition for divorce against his wife Jackie Soon in the High Court of Justice of Trinidad and Tobago. He is now applying for substituted service because attempts to personally serve Jackie have been unsuccessful. Ernest states that Jackie left their home in 2010 without informing him of where she was going. Several attempts by the court to serve her documents have been evaded. Ernest has tried to locate Jackie through contacts but with no success, except her sister Abigail says Jackie visits her regularly. Ernest believes that having the petition delivered to Abigail would ensure Jackie receives it, so he is requesting the court to allow substituted service by registered mail to Abigail.

EX PARTE APPLICATION FOR SUBSTITUTED SERVICE: I, ERNEST SOON, of No. 8 Toncabeen Gardens, Sun Valley, of the profession Lab technician in the island of Trinidad and Tobago make oath and say as follows;1.I make this affidavit in support of my application for substituted service of the petition filed herein on the 2nd September 2012 on the respondent.

PARTICULARS: a. The Respondent left the matrimonial home in or around the 16th of February, 2010 without the Petitioner's consent or knowledge of his intended residence. b. Several attempts have been made to serve the respondent with the appropriate documents by the representative of the court but she has frustrated and evaded each and every attempt to do so. Efforts were made to serve the respondent on three separate occasions. On 1st October 2012 and on 29th October 2012 the Respondent was found and deliberately evaded service. The third attempt at service was made on 15th November, 2012, which was also unsuccessful.

c. I have made extensive efforts to trace the Respondent but without success. There is now produced and shown to me marked E.S.3 a bundle of correspondence with various individuals and instructions with whom I know the respondent had contacted during the time we lived together. All state that they do not know the whereabouts of the Respondent, save the Respondents sister Abigail Chin who lives at 12 La Lune Gardens, who I have been reliably informed is visited by the Respondent regularly. d. I verily believe that if the petition were delivered to the respondent in the care of her sister Abigail Chin at 12 La Lune Gardens, she would receive it. I therefore ask this Honourable Court for an order for substituted service on the Respondent by such delivery by registered mail.
