Sanchez v. Comelec

1. Candidate Augusto Sanchez filed a petition before the COMELEC praying for a recount of votes from the May 11, 1987 senatorial elections to determine the true number of votes credited to him. 2. The COMELEC dismissed the petition, finding that errors in the appreciation of ballots by election inspectors are a subject for election protests, not recounts. Appreciation of ballots is done by election inspectors, not the board of canvassers. 3. Sanchez did not establish that the election returns were incomplete, tampered with, or contained discrepancies affecting election results - the only grounds for a pre-proclamation recount. His petition thus failed.
