A RESOLUTION REQUESTING HONORABLE RAMON J.P. PAJE, DENR SECRETARY THRU CHANNELS FOR THE FORMAL TURN-OVER OF COMMUNAL FOREST, PARCEL VII, ESTABLISHED UNDER FORESTRY ADMINISTRATIVE ORDER NO. 2-1519 DATED JULY 9, 1941 LOCATED AT AMBASSADOR, TUBLAY, BENGUET IN FAVOR OF THE MUNICIPAL GOVERNMENT OF TUBLAY, BENGUET. WHEREAS, Republic Act No. 7160, otherwise known as the Local Government Code of 1991, mandates that the Local Government Units (LGUs) shall share with the national government the responsibility in the sustainable management and development of the environment and natural resources within their territorial jurisdiction; WHEREAS, Section 17 of the Code provides that national agencies or offices concerned shall devolve to LGUs the responsibility for the provision of basic services and facilities; WHEREAS, pursuant to Republic Act No. 7160, the DENR issued Department Administrative Order No. 30 dated June 30, 1992 which provides the guidelines for the transfer and implementation of DENR functions to be devolved to the LGUs; WHEREAS, DENR-DILG-LGU Joint Memorandum Circular No. 98-01 provides the Manual of Procedures for DENR-DILG-LGU Partnership on Devolved and Other Forest Management Functions; WHEREAS, among the forest management functions of the DENR devolved to the municipal government is the management of existing communal forests within the municipality; WHEREAS, the general procedure of the devolution to and management of the communal forest by municipal governments call for the actual identification and assessment of existing communal forests to be undertaken by DENR, through its CENRO, and the concerned LGU to determine the sustainability of the existing communal forests; WHEREAS, Hon. Ruben E. Paoad, the Local Chief Executive of the Municipality of Tublay issued Administrative Order No. 1 dated April 20, 2012, creating an Assessment Team composed of personnel from DENR and municipal government of Tublay, Benguet;
WHEREAS, the DENR-LGU Assessment Team recommended that Communal Forest Parcel VII, established under Forestry Administrative Order No. 2-1519 dated July 9, 1941 located at Ambassador, Tublay, Benguet is still sustainable to achieve its purpose as communal forest and needs to be maintained and preserved; WHEREAS, among the requirements for the formal turn-over of the communal forest to the municipal government is the formulation and submission to the Provincial ENR Council for approval of a management plan governing the sustainable development of this communal forest; WHEREAS, the DENR and DILG have provided the LGU technical assistance in all facets of forest management planning and consequently formulated a Communal Forest Management Plan for the abovementioned communal forest to ensure sustainable development; WHEREAS, the Provincial ENR Council duly approved the Communal Forest Management Plan on March 20, 2013; WHEREAS, Section 8, 8.4.1 (b) of DENR-DILG-LGU Joint Memorandum Circular No. 98-01 provides that the Sangguniang Bayan where the communal forest is located shall pass a resolution requesting the DENR Secretary for the turn-over of said communal forest to the municipality based on the recommendation of the DENR-LGU Assessment Team; NOW, THEREFORE, on motion of Kag. Wilfredo C. Diano, duly seconded by the Body, be it RESOLVED, as it is hereby RESOLVED, to request Honorable Ramon J. P. Paje, DENR Secretary, to issue to order the official transfer of management of Communal Forest ParcelVII, established under Forestry Administrative Order No. 2-1519 dated July 1, 1941 located at Ambassador, Tublay, Benguet, in favor of the municipal government of Tublay, Benguet; RESOLVED FINALLY, that copy of this resolution be forwarded to Honorable Ramon J. P. Paje, DENR Secretary, Visayas Avenue, Diliman, Quezon City, for his appropriate action; let copies hereof be furnished to Hon. Nestor B. Fongwan, Provincial Governor, Benguet Province; Hon. Nelson C. Dangwa, Vice Governor, Benguet Province; DILG Provincial Director, Benguet Province; Regional Executive Director Clarence L. Baguilat, DENR-CAR, Diego Silang St., Baguio City; PENR Officer Godfrey L. Cawis, Benguet Province; CENR Officer Julio D. Lopez, Wangal, La Trinidad, Benguet, for their information and record;
