Lack of Deceit

The lower court incorrectly found Alma guilty of estafa through bouncing checks. To constitute estafa, the issuance of a bounced check must be the means to obtain money from the payee through fraudulent assurances. However, in this case Alma issued the subject check to Bernie in payment of a pre-existing obligation from previous loans. Bernie knew as early as September that Alma's account was closed when an earlier check bounced, so he could not claim to have acted on fraudulent assurances when discounting the February check. While Alma remains civilly liable, the case should be remanded for further evidence regarding the amount of her remaining obligation.
