Release of a Legacy
DEED OF RELEASE is made at ... this ... day of ... between Mrs. A
residing at ... hereinafter referred to as the Releasor of the One Part and
(1) ... and (2) ... the proving executors of the last Will and testament of
Mr... hereinafter referred to as the Releasees of the Other Part;
WHEREAS -
1. The said Mr... died on or about ... leaving his last Will and testa-
ment dated ...
2. The Releasees as executors of the said Will therein named, have
proved the said Will and obtained probate thereof from the High Court of
... on the day of ...
3. By the said Will the said testator has made a provision of Rs... for
the marriage expenses of his unmarried daughter the Releasor and the
said provision has been charged on the immoveable property of the said
deceased, which is more particularly described in the Schedule hereunder
written.
4. The estate of the said deceased is not sufficient to pay all liabilities
of the estate out of the moveable assets such as cash, bank balances and
securities and the Releasees are, therefore, required to sell the said im-
moveable property.
5. With a view to give a clear title to the Purchaser of his said prop-
erty, the Releasees have requested to the Releasor to release the said
property from the said charge as well as from the said provision for mar-
riage expenses
6. The Releasor is now married and does not desire to make any claim
to the said legacy.
NOW THIS DEED WITNESSETH that in the premises aforesaid, the
Releasor hereby renounces the said legacy in her favour and releases the
said property from the charge thereon created in her favour by the said
Will for payment of the said sum of Rs. ... for her marriage expenses to the
intent that the said property shall be freed and discharged of all claims
and right, of the Releasor in or to the said property by virtue of the said
Will or otherwise howsoever.
IN WITNESS WHEREOF the Releasor has put her hand the day and
year first hereinabove written.
