PrincipleofPermanentSovereigntyoverNaturalResources[6]

TheEastTimorTreatyviolatedtheGeneralAssemblyresolution1803(XVII)whichisbasedonanumber
ofpreviousUNresolutions.ThisresolutionsawtheestablishmentoftheCommissiononpermanent
sovereigntyovernaturalwealthandresourcesasabasicconstituentoftherighttoselfdetermination.
Numberofissueswereconsideredwhenthisresolutionwasdrafted,someofwhichinclude;

*Theresolutionistoencourageinternationalcooperationintheeconomicdevelopmentofdeveloping
countries'.

*ToestablishthesovereignrightofeveryStatetodisposeofitswealthanditsnaturalresourcesshouldbe
respected;

*itwasbasedontherecognitionoftheinalienablerightofallStatesfreelytodisposeoftheirnatural
wealthandresourcesinaccordancewiththeirnationalinterests,andonrespectfortheeconomic
independenceofStates;

*desirabilitytopromoteinternationalcooperationfortheeconomicdevelopmentofdevelopingcountries,
andthateconomicandfinancialagreementsbetweenthedevelopedandthedevelopingcountriesmustbe
basedontheprinciplesofequalityandoftherightofpeoplesandnationstoselfdeterminationand;

*particularimportanceofpromotingtheeconomicdevelopmentofdevelopingcountriesandsecuringtheir
economicindependencewastobegiven.

Thisabovecharter,althoughnotexhaustive,providesthefundamentalprincipleofPermanentsovereignty
overnaturalresources'andtheTherightofpeoplesandnationstopermanentsovereigntyovertheir
naturalwealthandresourcesmustbeexercisedintheinterestoftheirnationaldevelopmentandofthewell
beingofthepeopleoftheStateconcerned..
