WHEREAS, the parties are before the Court in agreement and the Court being in

all ways sufficiently advised HEREBY ORDERS:

1. The Respondent and Petitioner shall have joint custody of the

minor child, , age 2.

2. The Respondent shall be granted visitation with his son every other

weekend from Friday at 3:00 p.m. until Monday at 5:00 p.m. In the week following the

visitation the Respondent shall have visitation on Monday at 8:00 a.m. until Tuesday at

5:00 p.m. If either party is working or unable to care for the child for a period of 18

hours the other party shall be given the right to watch the child during those hours.

3. The Holiday schedule shall be as follows:

a. The mother shall have the child on Mother’s Day from

10:00 a.m. to 8:00 p.m. and the father shall have the child on

Father’s Day from 10:00 a.m. to 8:00 p.m.

b. The mother shall have the child on Christmas Eve from

10:00 a.m. until 10:00 a.m. on Christmas Day. The father shall

have the child from 10:00 a.m. on Christmas Day until 10:00

a.m. on the following day.

c. The Petitioner shall have Easter visitation in even years

from 9:00 a.m. until 8:00 p.m. The Respondent shall have

Easter visitation in odd years from 9:00 a.m. until 8:00 p.m.

d. The mother shall have the child on Thanksgiving in odd

years from 8:00 a.m. until 2:00 p.m. and the Father shall have

the child from 2:00 p.m. until 8:00 p.m. In even years the

Father shall from 8:00 a.m. until 2:00 p.m. and the Mother

shall have the child from 2:00 p.m. until 8:00 p.m.

e. The Father shall have the child on Halloween in even years

and the Mother in odd years. This visitation shall take place

from 5:00 p.m. until 9:00 p.m.

f. On the child’s birthday the child shall follow the normal

visitation schedule however, if the child is not with a party for

any part of the birthday that party shall have the child the

following Saturday from 9:00 a.m. until 8:00 p.m.

g. In even numbered years, the mother shall have the child on

New Year’s Day and July 4th and the father shall have the child

on Memorial Day and Labor Day. In the odd numbered years,

the mother shall have the child on Memorial Day and Labor

Day and the father shall have the child on New Year’s Day and

July 4th.

h. When the child begins school in even years the Father shall

have Spring Break with the child and the Mother shall have

Fall Break. In odd years the Father shall have Fall Break and

the Mother shall have Spring Break. This visitation shall

consist of each the afternoon after school is released at 5:00

until the day before school begins again at 5:00 p.m.

i. Each parent shall have the child two (2) weeks vacation

during the summer months until the child is three (3) years of

age. When the child is over three (3) years of age, the parties

shall each have four (4) weeks of visitation with no more than

two (2) weeks consecutive. Each party must give the other

party at least a thirty (30) day notice of his or her vacation

schedule. The Father’s schedule shall take precedent except on

years when the Mother has the 4th of July holiday shall she

shall be granted a seven day period of vacation around the 4th

of July. This seven day period shall be part of the Mother’s

earlier described summer vacation.

4. The exchange of the child shall take place at the home of the

Petitioner’s mother.

5. Petitioner shall continue to maintain health insurance on the child

so long as it is available to him through his employment and he shall pay child support to

the Petitioner in the amount of per month or per week pursuant to the attached child

support chart. The payments shall be through the Division of Child Support. Child

support shall paid by wage assignment to facilitate the payment of support. It is the duty

of the Petitioner to ensure a wage assignment is in place to be paid to Petitioner’s

address. Until such time as a wage assignment is in place child support shall be paid

directly to “The Division of Child Support”, P.O. Box 14059, Lexington, Ky., 40512. All

payments must include the IV-D number assigned for proper distribution.

6. Respondent shall be entitled to claim the child as a dependent for

income tax purposes for the tax year 2009. Thereafter the Petitioner shall claim the child

in even numbered years and the Respondent shall be entitled to claim the child as a

dependent for income tax purposes in odd numbered years.

7. The Respondent shall pay 50% of the uninsured medical expenses

for the child and the Petitioner shall pay 50% of the uninsured medical expenses of the

child. These percentages are derived from the child support income percentages of the

parties.

8. Neither party shall consume intoxicating substances such as

alcohol or drugs while caring for the child.

9. The parties shall each have equal access to all school, medical and

other records for the child.

10. This Order shall take the place of all prior Orders. This is a final

and appealable order in this matter.

11. Parties are to communicate directly regarding the child. Messages

shall not be sent through the child or third party.
