Summary of civil aviation act 1969
The Civil Aviation Act 1969 (Malay: Akta Penerbangan Awam 1969), is a
Malaysian law which was enacted to make better provision in the law relating to
Civil Aviation and for matters connected therewith and ancillary to it. In order to
regulate the airlines and airports services operations and civil aviation activities,
the Ministry of Transport adopted the following acts/regulations.
Civil aviation act 1969 has two important date which are:
Royal assent at 15 February 1969
Publication in the gazette at 27 February 1969.
The act 3 of civil aviation act 1969 divide into 10 part that use roman
numerical. It also, consists of 28 sections and consist of a few sub sections which
use the alphabetic word as an example section 6A. Commencement of Part IIIA.
The act shows the structure of the organization which is headed by a
director general and help by airworthiness director also an airworthiness advisor.
The act shows the responsibility that each member of delegation hold in Malaysia
such as its function, duties and delegation power.
Civil aviation act 1969 has power to implement the Power to give effect to
the Chicago Convention and regulate civil aviation to follow international
standard as the ICAO only provide standard and recommended practices The
Minister may make such regulations as he considers necessary or expedient to
give effect to and for the better carrying out of the objects and purposes of this
Act, to provide generally for regulating civil aviation and for carrying out the
Chicago Convention, any Annex to it and any amendments of such
Convention and Annexes.
Civil aviation act 1969 also charges fee and fines based on its law to
provide order and regulate the operation of airport or aerodome in the vicinity of
its authority. It also provide a way for safe and oderly manner for airliner to
operate. This help to control the flow of operation to a more efficient and achieve
international standard.
Civil aviation act 1969 act as a guide to investigate and collect information
based on the standard and recommended practices from ICAO for accident that
happen in Malaysia or aircraft registered in Malaysia such accident involve
beyond Malaysia border is the MH17 where the aircraft is shot down beyond
Malaysian border.
The Civil Aviation Act 1969, in its current form (27 August 2015), consists of 10
Parts containing 28 sections and 1 schedule (including 8 amendments).
