Vino Vs People

Lito Vino was charged as a principal for the murder of Roberto, but the evidence showed his participation was merely as an accessory. When Ernesto came to Roberto's aid after he was shot, he saw Lito Vino and Jessie Salazar riding away on a bicycle, with Salazar carrying an armalite. Salazar then pointed the armalite at Ernesto and others. The court held that while murder was committed by Salazar, the evidence only showed Vino assisted Salazar in escaping, making him an accessory rather than a principal to the crime.

G.R. No.

84163 October 19, 1989

LITO VINO, petitioner,
vs.
THE PEOPLE OF THE PHILIPPINES and THE COURT OF
APPEALS, respondents.

Facts:
When Ernesto came to the aid of Roberto who was shot, he saw
Lito Vino and Jessie Salazar riding a bicycle coming from the
south. Vino was the one driving the bicycle while Salazar was
carrying an armalite. Upon reaching Ernesto's house, Salazar
pointed his armalite at Ernesto and his companions. Thereafter,
the two left. In Roberto’s ante-mortem statement, Jessie Salazar
was Identified as his assailant. Petitioner was charged as a
principal in the commission of the crime of murder.

Issue:
Whether or not Lito Vino was correctly charged as principal?

Held:
No. There is no doubt that the crime of murder had been
committed and that the evidence tended to show that Jessie
Salazar was the assailant. While the petitioner was being held
responsible as a principal in the information, the evidence
adduced, however, showed that his participation is merely that of
an accessory. It is thus clear that petitioner actively assisted
Salazar in his escape. Petitioner's liability is that of an accessory.
