Christopher Martinez was arrested for aggravated assault, felony discharge of a firearm, domestic violence in the presence of a child, and criminal mischief. Officers responded to a call of domestic violence in progress and gunshots fired inside the home. They found bullet holes in an interior door and wood splinters near where Martinez stayed. Martinez' mother, son, and brother reported hearing gunshots but not seeing Martinez fire. His mother believed he fired in the kitchen while his brother thought it was on the stairs. She also saw him throw an object into a wall, putting a hole in it.

I believe there is probable cause to charge the defendant with these charges because:
On December 2, 2018, Taylorsville Patrol Officers (UPD) were dispatched to 4838
S Bayport Way on a domestic in progress. The complainant, Cindy Martinez stated
her son was armed with a gun and was shooting it in the house. Cindy told the
call taker there was not anyone injured and that she was in the bathroom. Cindy
advised her grandson was in the house and her son was shooting a handgun.
Cindy is the owner of the house and the suspect has a bedroom in the house,
specifically the northwest corner of the basement.
Prior to Officers arrival the suspect left the residence with his girlfriend in a vehicle.
The suspect and his girlfriend were later located at her residence in Taylorsville.
Your Affiant was told the suspect was in possession of 2 handguns, a 9mm and
.22 cal, when he arrived which were taken from him and later given to the Police.
Neither handgun had ammunition in them.
Officers conducted a protective sweep of the Bayport address and observed
multiple bullet holes to an interior door of the house near the kitchen. Officers also
observed wood splinters in the basement near the suspects room. According to
the suspects family, the suspect discharged an AR15 in the house previously this
week.
When the above incident occurred today the suspects mother (complainant), his
17 year old son and the suspects brother were in the house when the shooting
occurred. All three of the victims reported they only heard the gunshots but they did
not see the suspect shooting the gun. the complainant believes the suspect was
in the kitchen while shooting the gun and the suspects adult brother believes the
suspect was on the stairs when he shot the gun. After the shooting the complainant
observed the suspect throw an object at a wall and put a hole in it although she
did not know what the object was.
The suspect was taken into custody and is currently being interviewed by assisting
Detectives.
