                                               Narrative:
                                                 On Thursday, April 6th, 2018, I was working in full police uniform and driving a fully marked
                                               Burlingame Police vehicle (#4). On the above date at approximately 1400 hours I was contacted by my
                                               shift supervisor, Sergeant Terada, who asked that I conduct a welfare check on a Matthew Allen
                                               Weatherford, who was a former employee of Gilead. Gilead which is a biopharmaceutical company
                                               reported that Weatherford who was a former employee had reportedly ordered a number of high end
                                               medical tools on their corporate account, which was a cause for concern. These items included medical
                                               tools such as a bone scissors, forceps and a diamond knife. Additionally the order placement by

                                               Weatherford was after he had been terminated by Gilead. According to the reporting party, Amie Clark,
                                               who is head of security for Gilead, there was no want for criminal prosecution of Weatherman, but that
                                               they were requesting the Burlingame Police Department to conduct a welfare check on him. According
                                               to Gilead records, Weatherman was listed as living at 1461 Cortez Avenue in the City of Burlingame.
                                                  At approximately 1420 hours, Sergeant Terada, Corporal Orloff and this reporting officer responded
                                               to 1461 Cortez Avenue in order to attempt to locate Weatherford and ascertain his wellbeing. On
                                               arrival, Corporal Orloff alerted me that he could see a male working in an open garage up the driveway
                                               from the front of the residence. As I left the front porch of the residence where I was about to attempt
                                               contact I could see this male subject that Corporal Orloff had alerted me too, and from my having
                                               viewed a previous photo of Weatherford provided by Sergeant Terada, I recognized this male as being
                                               him. On walking up the driveway I announced my presence to Weatherford and asked to speak with
                                               him. Weatherford exited the open garage and met us just outside the garage.
                                                  I explained to Weatherman about the nature of the contact, which was being initiated by his former
                                               employer, Gilead. During my contact with Weatherford I noted a number of odd mannerisms.
                                               Weatherford was talkative. Weatherford was also animated, moving his hands about his upper body as
                                               he was talking with me. While we were not in direct sunlight, on looking at his eyes while we were
                                               speaking, I noted that Weatherford’s pupils appeared small in size and constricted.
                                                  On asking Weatherford about any medications he stated he was taking Albuterol and an Amoxicillin
                                               type anti-biotic (exact name of medication unknown). On asking about illegal drug or narcotic usage,
                                               Weatherford told me that he smoked marijuana regularly, with the last use being earlier in the morning.
                                               On asking about any recent drug usage, Weatherford mentioned using methamphetamines “a long time
                                               ago”. I then asked Weatherford to be truthful about his prior use of methamphetamines, adding that I
                                               was taking note of a number of oddities, including his small constricted pupils. Weatherford now
                                               responded that he had last used methamphetamines approximately “a day”ago. Weatherford said that
                                               he took methamphetamines by mixing it with his drinks, which yesterday consisted of putting it in his
                                               coffee. Weatherford also denied ever smoking methamphetamines.

                                                  I then explained to Weatherford that based on my observations along with his admitted recent use of
                                               methamphetamines that I was going to conduct an under the influence examination of him. On taking
                                               Weatherford’s pulse, I measured his heart rate to be elevated to approximately 138 beats per minute. I
                                               next had Weatherford close his eyes and estimate thirty seconds in time, after which he was instructed
                                               to reopen his eyes and state that he was done (Romberg Test). Weatherford close his eyes and reopened
                                               them after twenty-nine seconds in time had elapsed, during which time he was observed using his
                                               fingers to count with his lips moving in unison to assist with the time estimation, which he was
                                               expressly told not to do prior to starting the test. Weatherford refused to allow me to examine his eyes
                                               in the low level light of the garage, which was open next to use.
I now handcuffed Weatherford was advised that he was placed under arrest for a violation of:
                                                  As I was proceeding to conduct a post arrest search of Weatherford’s person, he warned me that he
                                               had a “glass pipe”in the front left pocket of the jeans he was wearing. A search of Weatherford led to
                                               me locating a glass cylinder tube open at one end with a ventilated opening at the opposite end. The
                                               glass tube at the ventilated end had burn and heat marks to the exterior of it and a whitish film coating
                                               the interior of it. From my training and experience I recognized this glass tube as having been configured
                                               as a smoking implement to smoke / ingest ‘cns’stimulants, and in specific methamphetamines.
                                                  I secured Weatherford in the backseat of my patrol vehicle and transported him to the Burlingame
                                               Police Department for processing. On our arrival in the booking area, Weatherford was read the
                                               ‘Examiner’s Admonition of Chemical Test’admonition. Weatherford signed the admonition and
                                               checked the box stating he was agreeing to submit to a chemical (urine) test. At approximately 1520
                                               hours, Weatherford provided a urine sample which was observed, collected and packaged as evidence
                                               by this reporting officer.

                                               Additional Information:
                                                       It should be noted that Weatherford was processed in the booking area of the Burlingame Police
                                               Department, which is monitored via department video and audio recording. These recordings are
                                               maintained by the Burlingame Police Department for a period of one year from the date of arrest, and are
                                               available on request. Additionally at the time of my contact with Weatherford, my department issued
                                               Axon body worn camera was worn and on, recoding the contact.
                                               Evidence:
                                                  The following items have been retained as evidence in this case:
                                                  ·   The urine sample obtained from Weatherford was booked into a refrigerated evidence box at
                                                      First Chance where it is awaiting transport and eventual analysis by the San Mateo County Crime
                                                      Lab.
                                                  ·   The glass tube configured into a pipe to smoke/ingest methamphetamines located in
                                                      Weartherford’s possession were photographed at the Burlingame Police Department, after
                                                      which time it was destroyed in accordance with department evidence booking policy.
                                                  ·   Digital photographs taken of the recovered glass pipe found in Weatherford’s possession, were
                                                      uploaded into the electronic evidence storage server at the Burlingame Police Department by this
                                                     reporting officer where they are being retained as evidence in this case.
                                                 ·   Camera footage from this reporting officer’s body camera, showing my contact with
                                                     Weatherford, was uploaded onto the Burlingame Police Department’s electronic evidence server
