INTRODUCTION

OJT or On-the-job Training is a hands-on method of preparing and

evaluation of graduating students who will face the realities in a real workplace environment.

This aims to armour the students with competent skills and development which is essential

for their future careers.

The training uses the existing tools, machines, documents, and experiences

in a workplace to teach the student trainees on how to effectively do their jobs. It is also a

way to teach the students to perform the task given though there is a lack of tools and

equipment in the office they are assigned. This will bring out the student’s resourcefulness,

efficiency and effectiveness to do the job.

The primary goal of OJT is not only to teach clerical and staff duties, but

also to teach the students on how professionalism is being practiced. Professionalism is the

conduct, aims or qualities that characterized a profession or professionals. In this way, they

let the students collect their knowledge gained from books and apply it in a real workplace.

The students are also being taught to separate personal emotions and practice the Code of

Ethics.

The most important goal of OJT is to teach the students to socialize with

different types of people. In a certain workplace, the student trainees will blend themselves

into a whole new environment with different types of professionals, like a new employee. In

that situation, the students shall learn on how to socialize themselves to be part of that

department. The student trainee can learn to act and to be sensitive especially when talking to

clients, co-workers, and immediate supervisor or boss. Socialization is one of the major

contributors for an employee to work well and have a strong connection with his colleagues.

It is one of building blocks of a workplace in order for it to have an effective outcome.

The College of Business, Entrepreneurship, and Accountancy (CBEA) has been the

center of Cagayan State University in providing competent, knowledgeable, and skilled

professionals for the business world. Throughout Region 2, the college produced graduates of

Accountancy, Entrepreneurship, Business Administration, Accounting Technology, and

Legal Management that performs excellently in their respective workplace. These graduates

possess the competencies promised by the college in their outcome-based performance which

are as follows:

THE BACHELOR OF SCIENCE IN LEGAL MANAGEMENT (LEGMA)

The Bachelor of Science in Legal Management is a four year course, specifically

concerned with laws. The course includes the topics pertaining to laws on business,

obligation and contracts, taxation, labor laws, and some other penal laws. It is considered a

pre-law for others who will pursue Bachelor of Laws and Letters because all subjects are the

same and it serves to be a preperatory course before entering the College of Law. However,

the main objective of this course is to provide legal practitioners and legal advisers that are

needed by both corporate or business laws and the Philippine Justice System. It is needed in

the corporate or business world because there are also laws to follow in the business.

AGENCY PROFILE

This chapter includes the facts about the agency which consists of the vision, mission,

quality policy/ objectives, the functions of the agency and the department which governs the

agency where I served my 400 hours of On-the-Job Training, the National Prosecution

Service Regional Office No. 02.

Mandate

The Department of Justice (DOJ) derives its mandate primarily from the

Administrative Code of 1987 (Executive Order No. 292). It carries out this mandate through

the Department Proper and the Department's attached agencies under the direct control and

supervision of the Secretary of Justice.

Under Executive Order (EO) 292, the DOJ is the government's principal law agency.

As such, the DOJ serves as the government's prosecution arm and administers the

government's criminal justice system by investigating crimes, prosecuting offenders and

overseeing the correctional system.

The DOJ, through its offices and constituent/attached agencies, is also the

government's legal counsel and representative in litigations and proceedings requiring the

services of a lawyer; implements the Philippine laws on the admission and stay of aliens

within its territory; and provides free legal services to indigent and other qualified citizens.

Functions

Administration of the Criminal Justice System

The DOJ investigates the commission of crimes and prosecutes offenders through the

National Bureau of Investigation (NBI) and the National Prosecution Service (NPS).

Likewise, the DOJ administers the probation and correction system of the country through the

Bureau of Corrections (BuCor), the Board of Pardons and Parole (BPP) and the Parole and

Probation Administration (PPA).

Legal Counsel of Government

The DOJ, through the Office of the Solicitor General (OSG) and the Office of the

Government Corporate Counsel (OGCC), acts as the legal representative of the Government

of the Philippines, its agencies and instrumentalities including government owned and

controlled corporations and their subsidiaries, officials and agents in any proceeding,

investigation or matter requiring the services of a lawyer.

EO 292 specifically designates the Secretary as Attorney-General and ex-officio legal

adviser of government-owned or controlled corporations (GOCC) and their subsidiaries. The

Secretary exercises administrative adjudicatory powers over all controversies between/among

government agencies, including government owned and controlled corporations including

their subsidiaries. This power of adjudication of the Secretary originally stemmed from

Presidential Decree No. 242, and is now embodied in Sections 66 to 71, Chapter 14, Book IV

of E.O. 292.

The Secretary is likewise empowered to act on all queries and/or requests for legal

advice and guidance from private parties and other officials and employees of the

government.

Regulation of Immigration

The DOJ provides immigration and naturalization regulatory services and implements

the laws governing citizenship and the admission and stay of aliens through the Bureau of

Immigration (BI). Also, under Administrative Order No. 142 dated August 23, 1994, the

Secretary or his duly-authorized representative is authorized to act on immigration matters,

including waiver of visas and admission of aliens, except deportation matters.

International Cooperation

The DOJ is the central authority of the Republic of the Philippines relative to

extradition and mutual legal assistance treaties (MLAT) on criminal matters and is involved

in several aspects of international cooperation such as the drafting and implementation of

legislation and agreements as well as the negotiation of extradition and MLAT. Moreover,

under Philippine Extradition Law (P.D. 1069), the DOJ handles requests for extradition

and/or mutual legal assistance and represents treaty partners in Philippine courts.

Provision of Free Legal Assistance

The DOJ provides free legal assistance/representation to indigents and poor litigants

as well as other qualified persons in criminal, civil, and labor cases, administrative and other

quasi-judicial proceedings and non-commercial disputes through the Public Attorney's Office

(PAO) pursuant to RA No. 9406.

Alternative Dispute Resolution

With regard to conciliation and mediation, the Alternative Dispute Resolution Act of

2004 (RA 9285) created the Office for Alternative Dispute Resolution (OADR), which is an

agency attached to the DOJ and which is tasked to promote, develop and expand the use of

alternative dispute resolution in civil and commercial disputes.

DOJ functions under other laws and other executive issuances:

In addition to performing its mandate under E.O. 292, the Department is significantly

involved in the implementation of the following penal, national security, and social welfare

laws:

The Witness Protection, Security and Benefit Act (R.A. 6981), which mandates the

DOJ to formulate and implement a Witness Protection, Security and Benefit Program for the

admission and protection of witnesses; Implementation of the Victims Compensation

Program through the Board of Claims created under the DOJ (RA 7309);

Administrative Order No. 99 (1988), designated DOJ as lead implementor of Justice

System Infrastructure Program (JUSIP) that was tasked to construct/rehabilitate decent office

buildings for judges, prosecutors, public attorneys, probation officers, and registers of deeds;

Executive Order 180 (1987), which created the Public Sector Labor Management Council, of

which the Secretary is a member, to provide guidelines for the exercise of the right of

government employees to organize;

The Comprehensive Dangerous Drugs Act of 2002 (RA 9165), which created the

Dangerous Drugs Board to see to policy-making and strategy-formulation on drug prevention

and control and designated the Secretary or his representative as ex-officio member of such

Board;

The Anti-Money Laundering Act of 2001 (R.A. 9160), which created the Anti-Money

Laundering Council (AMLC) to which the DOJ is a support agency through the investigation

of money laundering offenses and the prosecution of offenders. With the DOJ Anti-Money

Laundering Desk (DOJ-AMLD), the DOJ works in close coordination with the AMLC in its

task of combating money laundering and financing of terrorism; The Human Security Act of

2007 (RA 9372) which created and designated the Secretary as ex-officio member thereof.

Relative to this and under EO 292, the Secretary is also an ex-officio member of the

National Security Council (NSC), which advises the President with respect to the integration

of domestic, foreign, military, political, economic, social, and educational policies relating to

national security;

The Rape Victim Assistance and Protection Act of 1998 (RA 8505), which mandated

the DOJ to participate in inter-agency efforts to establish Rape Crisis Centers in every city or

province for the purpose of rendering assistance to rape victims;

The Anti-Trafficking in Persons Act of 2003 (R.A. 9208), which mandates the

prosecution of persons accused of human trafficking and for that purpose, created the Inter-

Agency Council on Trafficking (IACAT), of which the Secretary is Chairman;

The Anti-Violence Against Women and Their Children Act of 2004 (RA 9262),

which designated the Department as a member agency of the Inter-Agency Council on

Violence Against Women and their Children (IACVAWC), the monitoring body of

government initiatives to counter violence against women and children;

Executive Order 53 (2011) amending EO No. 275 pursuant to the Special Protection

of Children Against Abuse, Exploitation, and Discrimination Act (RA 7610), designating the

DOJ Secretary as the Chairperson of the Committee for the Special Protection of Children;

Anti-Child Pornography Act of 2009 (IRR of RA), designating the Secretary of

Justice as member of Inter-Agency Council Against Child Pornography that is tasked to

coordinate, monitor and oversee the implementation of Anti-Child Pornography Act;

Cybercrime Prevention Act of 2012 (RA 10175), the Office of Cybercrime within the

DOJ designated as the central authority in all matters related to international mutual

assistance and extradition;

Executive Order 45 (2011), which designated the DOJ as competition authority that

investigates all cases involving violations of competition laws and prosecute violators to

prevent, restrain and punish monopolization, cartels and combinations in restraint of trade;

Administrative Order 35 (2012), which designated the Secretary of Justice as

Chairperson of the Inter-Agency Committee on Extra-Legal Killings, Enforced

Disappearances, Torture and Other Grave Violations on the Right to Life, Liberty and

Security of Persons, the body that undertakes inventory of cases mentioned perpetrated by

state and non-state forces;

Memorandum Circular No. 68 (2014), creating an Inter-Agency Task Force to

Strengthen the Implementation of RA 8049 otherwise known as the Anti-Hazing Law, with

the DOJ Secretary as Chairperson.

Other tasks falling within the multifarious duties of the executive branch to administer

the laws devolve upon the Department through the Secretary, to wit:

The Anti-Dummy Law (Commonwealth No. 108), as amended by Presidential Decree 715,

whereby the Secretary is empowered to authorize the employment of aliens as technical

personnel in the management of a franchise, business or enterprise expressly reserved by law

to Filipino citizens or corporations or associations whose equity at least 60% of which is

owned by Filipinos; The Local Government Code (Section 187 of RA 7160) which vests in

the Secretary appellate jurisdiction over the constitutionality or legality of municipal tax

ordinances and revenue; measures; Executive Order 643 (2007) which vests the DOJ with

administrative supervision over the Presidential Commission on Good Government (PCGG).

The Secretary is also an ex-officio member of the Judicial and Bar Council (JBC) [Section

8(1), Article VIII of the 1987 Constitution], the Committee on Privatization [AO 48 (1987)],

and the National Water Resources Board (NWRB) (EO 123, series of 2002). He is also an ex-

officio director of the Power Sector Assets and Liabilities Management (PSALM)

Corporation (RA 9136, otherwise known as Electric Power Industry Reform Act of 2001).

Under EO 648, series of 1981, an undersecretary of the DOJ is designated as an ex-

officio Commissioner of the Housing and Land Use Regulatory Board (HLURB). In addition

to that, the agency’s pledge provides “We undertake to provide every person equal access to

justice, to faithfully safeguard constitutional rights and to ensure that no one is deprived of

due process of law. Our commitment is to advocate for reforms in partnership with our

stakeholders, to simplify processes, and re-engineer systems to best serve our constituents.

INTERNSHIP ACTIVITIES

This chapter contains the task and the job descriptions that the trainee's have done in

their internship agency.

Staff/Clerk Duties

The Office of the Regional Prosecutor (ORP) handles cases all over the region, this

means that the office is a busy one. The ORP never failed to give the best service they can

provide for their clients. As a student intern, we are directed to be the front liners and all-

around workers. This includes assisting clients, cleaning the office, assisting other staff or

employees and prosecutors and finishing or reproducing documents and doing paper works.

Case Filing

Our duty is to make sure that things are in order in the office. Since the workload is so

stressing at the office, given the numbers of cases that they handle, there is a need for them to

sort files accordingly. Being a student intern we are tasked to sort and file cases, and to

arrange them according to their criminal number. This shall help them to easily access the

cases.

Court Observation/Appearance

As a Legal Management student, there is a need for us to witness court proceedings.

During my internship, I was able to witness court proceedings pertaining to cases that

constitute violations of the Revised Penal Code and even civil cases. The office, specifically

the fiscals, exposed us to court proceedings because they know that this is beneficial for us.

We learned how court proceedings are done, the parts or stages of it, on cross-examining the

witness, presentation of evidence, and the promulgation of judgment. This activity inspired us

to study hard and be a lawyer someday.

Motion Making

In this task, I was asked by Prosecutor Lovelorn Gallano to make a Motion for Hold

Departure Order for her case to prevent the accused in leaving the country.

Database Making

In providing quality service to their clients, the ORP needs competent employees to

accomplish their goals and objectives. Our task is to create a database of these applicants of

different position in order for the office to have an accessible database in searching for a new

client. Listed on that database are: the name of the applicant, the position he is applying for,

the person who recommended him, trainings or seminars he attended, personal information

like telephone number, emails, the school where he graduated, the eligibility he has and

lastly, his previous employment. All of these are made to give a synchronized database for

new applicants in the office.

Arrangement of Application Files

In regards with the numerous applicants of the office, I was asked to arrange their

application files alphabetically based on their surnames. The office needs to keep these files

for future employments needed by the office.

Helped in conducting examination for applicants

Tasks are distributed accordingly in the ORP and every employee has a duty/ reports

to be done for the day. We are asked to assist the Officer-in-charge in conducting

examination for the applicants of the office. The examination serves as basis for them in

selecting the best applicant for the job.

Helped the HR Personnel in Arranging Files

In this task, we are asked to arrange files of the fiscals and employees, pertaining to

their accomplishment reports all over Region 2. We sorted them according to their names and

organized them according to the place of the office where they belong.

Facilitate in IACAT seminar

The Inter-Agency Council Against Trafficking (IACAT) selected me to be a

facilitator in their seminar. The activity is to monitor the number of cases reported in Region

2 and to inform the participants on how to properly submit their quarterly report on human

trafficking cases they’ve received at IACAT. The seminar is an eye opener for me on human

trafficking as a big issue in the country.

File Docketing

It is probably a rule in every office, that every file received should be recorded in the

logbook. In this task, we are asked to write the letters received by the office starting from the

year 2013-2016. We specified there the kind of letter the office received, whether designation

of personnel or designation of office. The logbook will be their guide in maintaining a

synchronized data and files in the office.

Paper Shredding

Due to confidential cases handled by the office, we are asked to shred files that

weren’t being utilized for the protection of people and the office as well.

Monitoring Office Supplies and Equipments

In this task, we are requested to check the supplies and equipments if they are still in

use or not. We also made a report on who is currently using the equipment and on homy

supplies are still available for use.

CHAPTER 4

PERFORMANCE HIGHLIGHTS, EXPERIENCES and

PROBLEMS ENCOUNTERED

The Office of the Regional Prosecutor (ORP) was created under Presidential Decree

No. 1275 during Ferdinand Marcos’ regime and still brought in to effect after the creation of

the 1987 Constitution. Primarily, it is the Department of Justice who has the duty to give the

citizens of the country remedies on prosecution services. The said Presidential Decree paved

way in the creation of sub-divisions of the Department of Justice creating the Office of the

Regional Prosecutor and Office of the Provincial and City Prosecutors. Its primary role is to

give prosecution services to avoid the miscarriage of justice. In Region 2, the ORP seats at

Tuguegarao City who handles cases all over the region. These cases pertain to the violation of

the Revised Penal Code and other special penal laws. They also provide services for witness

protection and Board of Claim

I choose the Office of the Regional Prosecutor as my working agency in this

internship program. I always dreamed of being part of an office whose duty is remarkably

huge and can make a great change in the society. It is also a way of decorating my resumè

and I can make connections in this office. The first time I entered the doors of the Office, I

was having chills on my body. I can still remember the feeling working with professionals

whom you don’t totally know. I managed to be myself and gave the best of me. I was

assigned for clerical or staff duties. We entertain clients of the office and make immediate

actions from their queries. The moment they’ve entered the office, our duty starts. Our main

duty is to assist the administrative staff and the human resource personnel. We arranged their

files, reproduced documents, and docketed files of the office. We also maintained the

cleanliness of the office in order form them to work well.

One of our duties is to assist the Fiscals in their cases. We sort their criminal cases

according to their criminal case number, and put them in their corresponding folders. We also

prepared questions for their cross examinations in court. Some of the Fiscals also invited us

to watch their court proceedings. This activity exposed us on how criminal proceedings are

done. It gives us knowledge on what are the stages of court proceedings; arraignment, pre-

trial, presentation of evidence and promulgation of judgment.

The highlights of our 400 hours internship at the Office of the Regional Prosecutor:

First, we were able to docket case or files from year 2014 to present. These files are letters

received by the office pertaining to Designation of Personnel and Memorandum Orders of the

Department of Justice. We also created a database for their applicants. Listed in this database

are the applicants’ personal information, training or seminar, eligibility, and previous

employment. This database shall serve as basis of the office for future employments needed

by them.

Second, we arranged the files of the staffs and the prosecutors. There was no database

when we came. That is we took the initiative to arrange their files for them to have easy

access on it. This is also a way maintaining organized files since there are a lot of paper

works in the office. The hardest to arrange are the files of employees, city and provincial

prosecutors all over the region.

Lastly, I was able to attend and facilitate the Inter-Agency Council Against Human

Trafficking (IACAT) Training. The IACAT is a sister agency of the Office of the Regional

Prosecutor. I feel so overwhelmed to be part of their seminar and selecting me among other

interns, it boosted my self-confidence. I was able to gain knowledge about human trafficking

which is becoming a big threat in the society. It was attended by the different employees of

the city and provincial prosecutors all over the region. The training was intended to monitor

cases received by every office and to deliver facilitate the delivery of their reports on the

IACAT. They’ve given them the template or format for their reports.

My stay at the ORP was so intense and challenging. Working with them gave me the

best training and helped me in the improvement of my competency as a future employee of

an agency or organization.

PROBLEMS ENCOUNTERED

Listed here are the problems I’ve encountered in my stay at the Office of the Regional

Prosecutor:

Firstly, working with the employees is a challenge, I have a good sense of humor that

is why other employees can approach me easily; I have a difficulty working with other

employees of the office. Some of the employees are not so approachable and I do limit

myself in communicating with them. Some are also talking things behind your back that is

why we learned to trust no one. However, we still managed to work well and gave our best.

Secondly, the office needed sorting and proper filing. A big agency like the ORP

should have an organize files because the office handles cases all over the region. Office

supplies are also messy. For this reason, during our stay at the ORP our work was focused

only on arranging files and supplies.

Thirdly, locating old files is extremely challenging. Since they don’t have organized

files we have the difficulty of locating them. These files are still important and yet the office

didn’t have a system of arranging and keeping these on separate folders or placed it on a

cabinet. Instead, all of these files are sealed in a box or kept in sack.

Next, we always did errands beyond our duty. Some employees asked us to withdraw

their salary which is a personal obligation. They took advantage of me having a vehicle. The

hardest thing is I can’t say no to them.

Lastly, creating a motion was a must. I don’t totally consider this a problem but more

of a challenge. I don’t have any knowledge on how to create a motion, so when Fiscal

Lovelorn Gallano asked me to create one, I felt so nervous. I figured it myself how to create a

motion and thankfully I did it. I felt so proud of my simple achievement.

CHAPTER 6

REFLECTION ON THE INTERNSHIP ACTIVITIES

During my last year in high school, our teacher gave us stories to read before we

entered college. These stories are equipped with lessons that helped us in handling college

life. One of the poems that I never forget is 'The Road not Taken'. The poem always reminds

me of taking the opportunity that is never been planned. Taking the road which other people,

despite of their intelligence and capability, refuse to take could be very challenging. The

poem also inflicts in my mind that the road is not always a straight path; there are curves, ups,

and downs. The journey of your road to success depends on you.

I planned to take my internship program in a big agency, but not as big as the Office

of Regional Prosecutor (ORP). I had anxieties in taking this road. I still remember the feeling

of my first day of internship. However, what we least planned turns out so well. I may not

have been where I am standing right now if I never took this road. The chills of my first day

paved way on the development of my skills and knowledge. I learned to go away from my

comfort zone and letting myself to be exposed and learn new things.

The first day of internship is full of excitement and fear. Working with different

fiscals and employees of ORP makes me feel so intimidated. Fear is all over my body; I

cannot work well, but I learned to set it aside. Whenever I am asked to do things, I always

take it even though there's fear in me. It is fulfilling on my part if I have accomplished things

that I totally don’t know. It means I learned from that task. Just like when Fiscal Lovelorn

Gallano asked me to make motion. I had no idea about it but I took the courage and set aside

fear. I researched on how to make a motion and asked for ideas from my co-student interns.

Thankfully, I managed to make one. From that scenario, you can see that fear can ruin you. It

is always better to commit mistakes rather that doing nothing to improve yourself.

There is really a big difference of knowing the theories and being immersed to real

work experiences. Even though you’ve mastered all theories and concepts of the workplace,

it does not apply on all circumstances. This is why On-the-Job Training was created to

simulate students to learn through immersion in the workplace. It is by way of teaching the

students not just to work but also to learn on how to socialize with different types of people. I

am grateful that we have a supervisor who is not self-centered and their major concern is for

us to grow.

One time that we were caught doing things that is outside of our duty. Our supervisor

explained to us that we are being observed by the employees and the feedback that she heard

was not so good. Instead of having grudges with the employees, we managed to change our

ways. The facts that they’ve given that feedback to us means they care for us and they want

us develop the professionalism and meet ethical standards. This already constitutes maturity

because you can already welcome criticism and convert it into a positive way.

When I entered the doors of ORP, I was not the man of yesterday when I left the

office. I can say that being with those professionals made a great impact on how I perceive

things today. Being a student intern of the ORP boosted my morale. I can say this because I

am planning to take up Bachelor of Laws and Letters however, I need more reasons before I

can fully commit myself in taking up that course. It really felt amazing that you got to work

with people, who have the same interest like you have. It is to avoid the miscarriage of justice

and to fight for people who have less voice to fight for themselves.

The most important thing I have learned in the internship program is that it is really

hard to earn money. We worked all day long and not being compensated. The pain we have

encountered was incomparable. I am in an inch of giving up but still managed to give my best

for my family and love one. All things are paid off by memories that I can use for my future

career. The connections we've built is a treasure and working with them is an honor. I wish I

could work with them in a longer span but time is running out for us. Working at the ORP

changed me not just to be a better individual but also a better professional.

The internship program was like driving a vehicle and there is a long road to take. The

travel will depend on you as a driver. You might encounter difficulties of reaching your

destination. In your way, there are some checkpoints and de-Tours. It is not always the span

of time you can reach it but it is more on crafting yourself along your way. The development

you need is not dependent on the people around but for you to figure out. Now, I finished a

new chapter of my life, an achievement for me to consider. The 400 hours of training made

me feel blessed because I acquired the best training I can have. The training experiences

RECOMMENDATIONS

This chapter contains the recommendation of the student trainee on his experience in

his internship program.

To the Office of the Regional Prosecutors

The agency, which played the biggest role on my internship program, here are some

recommendations to improve the quality of service we can provide to our clients:

- To have an IT expert for the creation of a database pertaining to the files of the

office in order for them to have easy access to these. We are living in the modern

world of technology and computer use is unavoidable;

- To let the employees and staff to acquire training on computer programming and

database making since I observed that most of the employees still lack knowledge

about it;

- Lastly, to maintain what we’ve started. To have an organized files to maintain

everything in order for them to have a healthy working environment to work with.

To the College of Business, Entrepreneurship and Accountancy

In conducting internship program for students, the college should consider

establishing connections with different agencies. Most of my classmates are settling in the

same office. I would like to recommend them to take partnership on different agencies to

working with the agency you want is to give an overview to study and work really

hard.
