ANSWER

I, Carlo Mamac, single, of legal age, Filipino citizen of 456 Modesto


Bangkal, Davao City, after having been sworn in accordance with law, do hereby
depose and say that:

1. Paragraph 1 of the complaint is admitted;

2. Paragraph 2 of the complaint is admitted;

3. Paragraph 3 is partially admitted. While it is true that the plaintiff is the


owner of a land embraced under Transfer Certificate of Title No. T-14344,
the same has, however, already been cancelled. One-half of the same subject
property is now covered by a new Transfer Certificate of Title No. T-15355
under the name of Carlo Mamac;

4. Paragraph 4 of the complaint is admitted;

5. Paragraph 5 of the complaint is admitted;

6. Paragraph 6 of the complaint is admitted.

7. Paragraph 7 is partially denied. While it is true that defendant has stayed in


the house of the plaintiff since February 2018, said Memorandum of
Agreement, has already been impliedly terminated by virtue of the
subsequent execution of a Deed of Sale in favor of the defendant.

8. Paragraph 8 of the complaint is admitted.


9. Paragraph 9 of the complaint is denied. The truth of the matter is that no oral
demands were made after the defendant sent his reply to the previous written
demand from the plaintiff.

10. I am executing this affidavit to attest to the truth of the foregoing averments.

Wherefore, in the interest of justice, it is respectfully prayed that the instant


complaint be DISMISSED for lack of merit.
