A trademark is a design, sign or expression that identifies a product or service. This differentiates a product or service of the company from other companies. Trademark owners can be organizations, businesses, legal entities or individuals. Trademarks are usually found on packages, vouchers or stickers on the products themselves. To improve the corporate identity, branding can also be displayed in the company’s buildings.

In most countries, you must register your company trademark before you can file a claim for trademark infringement. Common law trademarks give its owner less legal protection than less registered trademarks.

Mostly, logos, pictures, words, phrases, images or combinations of such elements can be called as trademarks. Non-conventional brands are trademarks that do not fall into these categories. They can be based on smell, color or even the sound of jingles. Trademarks may also informally refer to certain distinctive features that identify an individual, for e.g. characteristics that make celebrities recognizable. Trademarks used to identify services of products are known as service marks.

Various goods and services are divided into different classes in accordance with the International Classification of Goods and Services. There are 45 trademark classes. Classes 1 to 34 covering products, and services covered by classes from 35 to 45. This system allows you to clarify and limit any expansion of intellectual property rights. It determines the goods and services covered by the brand. Also, unites all classification systems in the world.

A trademark is one of the company’s core assets for any successful brand. Registration of trademarks can give your products and services the necessary protection and repels underhand methods of competition. If you do not register your brand can leave you at the mercy of your competitors. Do not let this happen to your brand.
