La violencia familiar y su implicancia en la suspensión de la patria potestad

    El presente trabajo investigativo se titula: La Violencia Familiar y su Implicancia en la Suspensión de la Patria Potestad, el cual tuvo como objetivo general determinar qué vínculo se establecen entre la violencia familiar y la suspensión de la patria potestad en los Juzgados de familia de Lima Este en el año 2020. Desde el punto de vista metodológico se enmarcó en una investigación cuantitativa bajo el paradigma positivista, con enfoque descriptivo y correlacional, la cual presenta un diseño de campo no experimental. Se usó para el estudio una muestra representativa de 35 sujetos, donde se realizó un muestreo no probabilístico por beneficio o conveniencia, fue aplicado como instrumento un cuestionario estructurado. Finalmente, se llegó a la conclusión que existe un vínculo determinante entre la violencia familiar y la suspensión de la patria potestad, puesto que el análisis estadístico indica la existencia de la relación entre las variables investigadas, por medio de la correlación de Rho de Spearman arrojo 1.000 indicando que la correlación es positiva y el p-valor de 0,000 menos que 0,05, por lo que se puede aseverar que dicha relación existe y es estadísticamente significativa. Por tal sentido, se admite la hipótesis de investigación y se refuta la hipótesis nula; en otras palabras. se llega a la determinación que sí existe una relación evidente entre la violencia familiar y la suspensión de la patria potestad.

    The present research work is entitled: Family Violence and its Implication in the Suspension of Parental Rights, which had the general objective of determining what link is established between family violence and the suspension of parental rights in the Family Courts of East Lima in the year 2020. From the methodological point of view, it was framed in quantitative research under the positivist paradigm, with a descriptive and correlational approach, which presents a non-experimental field design. A representative sample of 35 subjects was used for the study, where a non-probabilistic sampling by benefit or convenience was carried out, and a structured questionnaire was applied as an instrument. Finally, it was concluded that there is a determining link between family violence and the suspension of parental authority, since the statistical analysis indicates the existence of a relationship between the variables investigated, by means of Spearman's Rho correlation yielded 1,000 indicating that the correlation is positive and the p-value of 0.000 less than 0.05, so it can be asserted that this relationship exists and is statistically significant. In this sense, the research hypothesis is admitted and the null hypothesis is refuted; in other words, it is determined that there is an evident relationship between family violence and the suspension of parental rights.
