El valor del dictamen pericial de parte frente al elaborado por los peritos designados a través del tribunal, la alternativa del litigante de aportarlo al proceso y la esencia de la credibilidad del dictamen emitido por un perito directamente designado por la parte son algunas de las cuestiones que plantea el modelo dual de pericia incorporado a la Ley Procesal desde la reforma operada por la Ley 1/2000, mediante el que se permite a las partes optar entre la pericia privada o la designación de peritos a través del tribunal. Este trabajo analiza determinadas cuestiones escogidas en el ámbito de la prueba pericial de parte en el proceso civil.
The value of the expert opinion of a party against that prepared by the experts appointed through the court, the alternative of the litigant to contribute to the process and the essence of the credibility of the opinion issued by an expert directly appointed by the party are some of the issues raised by the dual model of expertise incorporated into the Procedural Law since the reform operated by Law 1/2000, by which the parties are allowed to choose between private expertise or the appointment of experts through the court. This paper analyzes selected issues in the field of expert evidence of part in the civil process.
