Resumen de De la incertidumbre y el proceso del Brexit: ¿Qué hay de los derechos de los ciudadanos?

proceso de divorcio entre Reino Unido y la Unión Europea, denominado Brexit constituye en este momento y, a buen seguro durante los próximos años, uno de los vértices de la incertidumbre que caracteriza la época que vivimos. Algunas de las piezas clave del modelo social europeo han desempeñado un papel protagonista en el escenario del proceso de salida. Al mismo tiempo este modelo social constituye uno de sus grandes damnificados. El objeto de este artículo es abordar la libre circulación de personas y sus consecuencias como uno de los factores que determinaron la inclinación del referéndum del 23 de junio de 2016 hacia la salida de Reino Unido de la Unión Europea. Igualmente, analizaré la regulación del fin de la libre circulación de personas en el Acuerdo de Retirada de 25 de noviembre de 2018 y los espacios de incertidumbre que afectan a los que he denominado “ciudadanos Brexit” durante el periodo de transición y en el periodo post Brexit. Finalmente, me referiré a una incertidumbre todavía más amplia: la que se proyecta sobre los derechos de los ciudadanos en un escenario de no acuerdo.

The withdrawal process of the United Kingdom from the European Union, known as Brexit, constitutes at this moment and, for sure, during the next few years, one of the vortex of uncertainty that characterizes the time we live. Some of the key pieces of the European social model have played a leading role in the scenario of the exit process. At the same time, this social model constitutes one of its great victims. The purpose of this article is to address the free movement of persons and its consequences as one of the factors that determined the inclination of the referendum of June 23th, 2016 towards the departure of the United Kingdom from the European Union. Likewise, I will analyze the regulation of the end of the free movement of persons in the Withdrawal Agreement of November 25th, 2018 and the areas of uncertainty that affect what I have called “Brexit citizens” during the transition period and in the post-Brexit period. Finally, I will refer to an even broader uncertainty: that which is projected on the rights of citizens in a no deal scenario.
