La política de autogobierno de la FIFA condiciona el funcionamiento del sistema de traspasos y cesiones que se recoge en el Reglamento sobre el Estatuto y la Transferencia de Jugadores (RETJ). El mercado de fichajes se caracteriza por la desigualdad económica de los clubes y la falta de transparencia. Se conocen los datos, pero no lo que hay detrás y alrededor de cada operación. La “naturaleza mixta” de la relación laboral de los deportistas profesionales da cobertura jurídica a un sistema que favorece la especulación y estrangula los derechos más esenciales de los futbolistas. La configuración de los derechos federativos y de su vertiente patrimonial –los derechos económicos– atribuye el control de la relación laboral a los clubes y a las federaciones. Y ese es precisamente el problema.

FIFA's policy of self-government conditions the operation of the transfer and transfer system set out in the Regulations on the Statute and Transfer of Players (RETJ). The transfer market is characterized by the economic inequality of the clubs and the lack of transparency. The data is known, but not what is behind and around each operation. The "mixed nature" of the employment relationship of professional athletes gives legal coverage to a system that favors speculation and strangles the most essential rights of footballers. The configuration of the federative rights and their heritage aspect –the economic rights– attributes the control of the labor relation to the clubs and the federations. And that is precisely the problem.
