De Kioto a París: ¿Evolución o involución de las negociaciones internacionales sobre el cambio climático?

    El Convenio Marco sobre el Cambio Climático de 1992 y el Protocolo de Kioto de 1997 constituyen la respuesta de la comunidad internacional al fenómeno del cambio climático. La próxima Conferencia de las Partes en ambos instrumentos tendrá lugar en diciembre de 2015 en París y supondrá un auténtico punto de inflexión en la evolución de este régimen internacional. Su conclusión exitosa exigirá superar la actual falta de apoyo y de confianza entre las Partes.

    Este trabajo aborda en su primera parte la evolución de las negociaciones internacionales en torno al cambio climático. Seguidamente, presenta las posiciones de los distintos grupos de negociación y las principales cuestiones que serán objeto de los trabajos de la Conferencia de París, haciendo especial hincapié en la naturaleza jurídica del instrumento resultante de la misma y en el contenido de las obligaciones relativas a la mitigación y a la adaptación al cambio climático.

    The United Nations Framework Convention on Climate Change (UNFCCC) in 1992 and the 1997 Kyoto Protocol represent the response of the international community to the challenge of climate change. The next Conference of the Parties (COP 21) on both will take place in December 2015 in Paris and should represent a real turning point in the evolution of the international agreement. To get a successful conclusion it will require overcoming the current lack of support and confidence between the parties.

    The first part of this paper focuses on the evolution of the international negotiations on climate change. Then, it presents the positions of the various negotiating groups and the main issues that will be on the table during the Paris Conference, with particular emphasis on the legal nature of the instrument resulting from the Conference and the content of the obligations relating to mitigation and adaptation to Climate Change.
