    El pontificado de Francisco presta una especial atención a los retos pastorales —y jurídicos— del matrimonio y la familia, haciéndolo además desde una perspectiva peculiar: la sinodal. A partir de la celebración del gran Sínodo sobre la Familia de los años 2014 y 2015, se ha sucedido una notable actividad magisterial y legislativa que interpela al derecho matrimonial canónico. En este artículo se reflexiona sobre algunas de las cuestiones más directamente interpeladas por el proceso sinodal, como son la propuesta pontificia de renovación de la formación para el matrimonio, el papel del discernimiento en la génesis del consentimiento y sus implicaciones en la interpretación del grave defecto de discreción de juicio, la necesaria profundización doctrinal y jurisprudencial de la ordenación del matrimonio al bonum coniugum, y el reto abierto de integrar mejor la dimensión pastoral y familiar (el bonum familiae) en el sistema matrimonial canónico, sustantivo y procesal.

    The pontificate of Pope Francis pays special attention to the pastoral — and juridical — challenges of marriage and the family and does so from a particular perspective: the synodal one. Since the celebration of the great Synod on the Family in 2014 and 2015, there has been an intense magisterial and legislative activity which also concerns marriage canon law. This article reflects on some of the issues most directly challenged by the synodal process, such as the pontifical proposal for the renewal of marriage formation, the role of discernment in the genesis of consent and its implications for the interpretation of the grave defect of discretion of judgement, the need for a doctrinal and jurisprudential deepening of the ordination of marriage to the bonum coniugum, and for a better integration of the pastoral and family dimension (the bonum familiae) in the canonical, substantive and procedural marriage system.
