    La propiedad de los montes es una especificación del concepto genérico de propiedad delimitada por su propio objeto. La Constitución de 1978 recoge la función social que toda propiedad debe cumplir (artículo 33), exigencia que aparece claramente agravada en el caso forestal. Pero tal régimen legal no puede suponer reducción ni limitación del núcleo esencial de los derechos de la propiedad. Los montes se encuentran sometidos a diversas normas de diferentes orígenes, muchas de ellas leyes con base forestal (incluyendo normas específicas sobre ciertos tipos de propiedad forestal, como los montes vecinales). Además, hay muchas restricciones a los derechos de los propietarios de montes en normativas sectoriales que no tienen una base forestal (de aguas, de carreteras, de patrimonio histórico, etc.).Con estas consideraciones, se propone una política forestal para conseguir los siguientes objetivos: Intervención equilibrada de la Administración, simplificación del número de administraciones intervinientes en el monte, unificación de sus acciones y creación de organismos específicos sobre la materia, desarrollo de una “Cédula de la propiedad forestal” y de un “Código forestal”.

    The ownership of forests is an specification of the concept “ownership” delimited by its own object. The Spanish Constitution of 1978 has compiled the social function that all ownership must fulfill (article 33). This exigency appears clearly aggravated in forest matter almost determining its "status" as "a tied" ownership. But such legal regime cannot suppose reduction nor limitation of the essential nucleus of the right of ownership constituted by the disposition faculties and use of its holder. Forests are under several norms of different origins. Many of them are forest based laws (including specific norms about certain types of forest ownership as community forests). Nevertheless there are many restictions to the rights of forest owners without a forest based origin (like those regarding to waters, highways, historical heritage, etc). With this considerations a forest policy is proposed in order to achieve the following objectives: balanced intervention of the Administration, simplification of the number of intervening Administrations on the forest, unification of its actions and creation of specific organisms on the matter, development "certificate of the forest ownership" and of a Forest Code.
