Resumen de Liberdade de Expressão na Era Digital: A Autorregulação Regulada

Freedom of expression is an unquestionable value in contemporary liberal democracies. The present work starts from this premise to analyze the current state of freedom of expression in the context of the digital age that has brought with it the protagonism of internet applications providers as new central actors that facilitate, mediate and also control speech in the digital sphere. The problem of fake news, the characteristics of this new digital age and these powerful internet applications providers, the discussion about possible regulation of this activity and some existing models of so-called regulated self-regulation are approached.

A liberdade de expressão é um valor inquestionável nas democracias liberais contemporâneas. O presente trabalho parte desta premissa para analisar o estado atual da liberdade de expressão no contexto da era digital que trouxe consigo o protagonismo dos provedores de aplicações de internet como novos atores centrais que propiciam, intermediam e também controlam o discurso na esfera digital. São abordados o problema das notícias falsas, as características desta nova era digital e destes poderosos provedores de aplicações de internet, a discussão sobre eventual regulamentação desta atividade e alguns modelos já existentes sobre a chamada autorregulação regulada.
