    La consolidación de los procesos constituyentes democráticos característicos del liberalismo revolucionario a partir de finales del siglo XVIII y principios del XIX generó la reacción conservadora de las fuerzas sociales y económicas, que se marcaron como objetivo detener el carácter emancipador del concepto poder constituyente. De entre estos esfuerzos destaca el despliegue del concepto formal de poder constituyente, concebido como “condición monstruosa” en términos de Donoso Cortés, destinado a encadenar al poder constituyente dentro del marco teórico de la juridicidad y la excepcionalidad, lo que repercutió negativamente en el avance de la libertad y la justicia social. Tres constructos destacaron en el concepto formal de poder constituyente: la soberanía compartida, el nominalismo de los derechos constitucionales y el “poder constituyente constituido”. El trabajo analiza críticamente estos argumentos que alimentan, aún hoy, amplios debates doctrinales sobre la naturaleza del poder constituyente.

    The consolidation of the democratic constituent processes characteristic of revolutionary liberalism from the end of the 18th centu- ry and the beginning of the 19th century generated the conservative re- action of the social and economic forces that set themselves the objective of stopping the emancipatory character of the constituent power concept. Among these efforts stands out the deployment of the formal concept of constituent power, conceived as a "monstrous condition" in terms of Donoso Cortés, intended to chain the constituent power within the theoretical framework of legality and exceptionality, which had a negative impact on progress of freedom and social justice. Three creations stood out in the formal concept of constituent power: shared sovereignty, nominalism of constitutional rights, and “constituted constituent power”. The work critically analyzes these arguments that feed, even today, broad doctrinal debates about the nature of the constituent power.
