Please Read These Terms Carefully

These Terms of Service (the "Terms") govern your access to and use of Discortics™ websites, Discord bots, dashboard, documentation, support channels, paid plans, and related services (the "Services"). "Discortics", "we", "us", and "our" refer to the operator of the Services. "You" means the person using the Services and, where applicable, the Discord server, organization, business, or other entity on whose behalf the Services are used.

By using the Services, adding a Discortics bot to a Discord server, authorizing the dashboard, purchasing a plan, or continuing to use Discortics after these Terms are posted, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the Services.

1. Eligibility and Authority

You must be at least 13 years old and old enough to use Discord and enter into these Terms under the laws that apply to you. If you use the Services on behalf of a Discord server, company, community, or organization, you represent that you have authority to bind that entity and manage the applicable Discord server, bot permissions, data, billing, and configuration.

You are responsible for ensuring that your use of Discortics complies with Discord's Terms, Community Guidelines, Developer Terms, Developer Policy, and all applicable laws.

2. Discord Platform Relationship

Discortics is an independent service that operates on or alongside Discord. Discortics is not Discord Inc. and is not endorsed by Discord unless expressly stated by Discord.

Discord controls the Discord platform, APIs, accounts, permissions, rate limits, outages, enforcement actions, and policy requirements. We are not responsible for Discord's services, actions, restrictions, downtime, API changes, or enforcement decisions.

3. Your Account, Server, and Permissions

You are responsible for:

  • Maintaining access to your Discord account and dashboard session.
  • Granting only the permissions required for the features you choose to use.
  • Reviewing server configuration, bot permissions, channels, roles, and access controls.
  • Actions taken by people who have permission to manage your server, account, dashboard, payment method, or bot settings.
  • Content, configuration, automations, rules, logs, tickets, applications, suggestions, giveaways, levels, economy data, and other materials submitted to or generated through your use of the Services.

We may rely on Discord permissions and dashboard authentication when determining whether a user may manage a server.

4. Service and Transactional Notices

Discortics may send non-marketing service, operational, transactional, account, feature, policy, security, billing, migration, reliability, or announcement notices to users or Discord servers that have chosen to install, configure, purchase, or otherwise use Discortics.

These notices may be sent through Discord messages, dashboard notices, support channels, email, or other reasonable channels. They may include information about service status, material feature changes, administrative action required, policy changes, billing, security, migrations, product availability, or other operational matters related to Discortics.

You agree that these notices are part of the Services and are not unsolicited marketing when sent to a user or server that uses Discortics. Server administrators remain responsible for removing the bot, changing settings, or contacting support if they no longer want Discortics to operate in a server, subject to any legally required or security-critical communications.

5. Acceptable Use

You may not use the Services to:

  • Violate any law, regulation, court order, intellectual property right, privacy right, publicity right, contract, or platform rule.
  • Violate Discord's Terms, Community Guidelines, Developer Terms, Developer Policy, or API rules.
  • Harass, threaten, abuse, exploit, dox, spam, phish, defraud, impersonate, or harm others.
  • Process, solicit, publish, or distribute unlawful, sexual, exploitative, abusive, hateful, violent extremist, malware, credential, token, or payment data.
  • Collect, expose, sell, or misuse personal data without proper authority and legal basis.
  • Interfere with, overload, scrape, probe, reverse engineer, bypass, disrupt, or attack the Services, Discord, or any third-party system.
  • Abuse trials, promotions, credits, refunds, chargebacks, subscriptions, or support.
  • Use Discortics in a way that creates legal, security, operational, reputational, or platform risk for us or others.

We may investigate suspected violations and may suspend, limit, remove, delete, disable, or terminate access, features, content, configuration, data, or accounts where we reasonably believe it is necessary.

6. User Content and Configuration

You retain ownership of content and configuration you lawfully provide to the Services. You grant Discortics a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, modify, process, and use that content and configuration as needed to provide, secure, support, improve, and enforce the Services.

You represent that you have all rights and permissions needed to submit content and configuration to Discortics and to allow us to process it under these Terms and the Privacy Policy.

We are not required to monitor user content, but we may review, remove, restrict, or disclose content where required by law, platform policy, security, support, abuse prevention, or enforcement needs.

7. Paid Services, Billing, and Taxes

Some Services may require payment. Prices, plan limits, features, renewal terms, and billing intervals may be shown at checkout, in the dashboard, or in related plan documentation.

By purchasing a paid Service, you authorize us and our payment providers to charge the payment method provided for applicable fees, renewals, taxes, and adjustments. Unless stated otherwise, subscriptions renew automatically until cancelled.

You are responsible for taxes, payment method accuracy, billing contact accuracy, and ensuring that you are authorized to use the payment method. We may suspend or terminate paid features for failed payments, chargebacks, fraud risk, abuse, or violation of these Terms.

8. Refunds and Cancellations

Refunds and cancellations are governed by our Refund Policy. Digital services, credits, subscriptions, custom bots, premium features, and usage-based products may be non-refundable once delivered, activated, consumed, abused, discounted, customized, or outside the applicable refund window, except where required by law.

Cancelling a subscription stops future renewals but does not automatically refund past charges unless the Refund Policy or applicable law requires otherwise.

9. Availability and Changes

We may add, remove, suspend, limit, modify, replace, or discontinue any part of the Services at any time. We may change feature limits, pricing, plans, infrastructure, commands, modules, APIs, dashboard pages, or bot behavior where needed for reliability, security, legal compliance, Discord compliance, product improvement, or business reasons.

We work to keep Discortics reliable, but we do not guarantee uninterrupted, error-free, or permanent availability. Outages, maintenance, Discord API changes, rate limits, infrastructure failures, data loss, or third-party issues may occur.

10. Suspension and Termination

We may suspend, restrict, or terminate your access to the Services, remove the bot, disable features, delete configuration, or refuse service where we reasonably believe that:

  • You violated these Terms, the Privacy Policy, Refund Policy, Discord rules, or applicable law.
  • Your use creates risk to users, Discord, Discortics, third parties, infrastructure, payments, or security.
  • Required payments fail or are disputed.
  • We are required to do so by law, platform rules, payment providers, or security needs.
  • The Services are discontinued or materially changed.

You may stop using Discortics by removing the bot, cancelling subscriptions, and ceasing use of the dashboard and website. Some obligations survive termination, including payment obligations, licenses needed for prior operation, disclaimers, limitations of liability, indemnity, and dispute provisions.

11. Intellectual Property

Discortics, including its software, website, dashboard, bot code, designs, branding, trademarks, documentation, and related materials, is owned by us or our licensors and is protected by intellectual property laws.

These Terms do not grant you ownership of Discortics or permission to copy, resell, sublicense, reverse engineer, exploit, or create confusingly similar services from Discortics except as expressly allowed by us in writing.

12. Privacy

Our Privacy Policy explains how we collect, use, store, protect, and share information. By using the Services, you agree to the Privacy Policy and confirm that you have provided any notices or obtained any permissions required for your server's use of Discortics.

13. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, or error-free operation.

Discortics does not guarantee that moderation, automation, verification, tickets, logs, backups, security features, dashboard controls, or other features will prevent all harm, detect all violations, preserve all data, or operate without error.

14. Limitation of Liability

To the maximum extent permitted by law, Discortics and its owners, operators, affiliates, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, reputation, goodwill, revenue, business, or access.

To the maximum extent permitted by law, our total liability for all claims relating to the Services will not exceed the greater of the amount you paid to Discortics for the Services giving rise to the claim during the three months before the event giving rise to liability or USD $50.

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

15. Indemnity

You agree to defend, indemnify, and hold harmless Discortics and its owners, operators, affiliates, employees, contractors, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to your use of the Services, your content or configuration, your server, your violation of these Terms, your violation of law or platform rules, or your infringement or misuse of another person's rights.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the Services after an update means you accept the updated Terms to the extent permitted by law.
