By accessing or using LuxSign ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
LuxSign provides electronic signature services allowing users to upload, send, and sign documents electronically. The Service is provided "as is" and "as available" without warranties of any kind.

Subscription fees are charged in advance on a monthly basis. All fees are non-refundable, except where a refund is required by law — including the consumer right of withdrawal described in section 6. LuxSign reserves the right to change pricing at any time with thirty (30) days' notice to existing subscribers.
You may cancel your subscription at any time through your account settings or by contacting support [at] luxsign.lu. Upon cancellation, your subscription will remain active until the end of the current billing period, after which you will be downgraded to the Free plan.
If you are a consumer resident in the European Union, you have the right to withdraw from a paid subscription within 14 days of concluding the contract, without giving any reason.
Send an unambiguous statement of your decision to withdraw to support [at] luxsign.lu, from the email address associated with your account. No particular form of wording is required. We will confirm receipt and refund all payments received from you within 14 days of being informed, using the same means of payment you used.
Paid features are made available as soon as your subscription begins. By starting a paid subscription you expressly request that performance begins during the withdrawal period, and you acknowledge that you lose the right of withdrawal once the service has been fully performed. If you withdraw after performance has begun, you remain liable for an amount proportionate to the service already provided up to the moment you inform us, calculated against the total price of the subscription.
Withdrawal ends the subscription contract between you and LuxSign. It does not affect documents you have already signed, or signatures already applied to them: those remain valid and enforceable between you and the other parties to those documents, and cannot be reversed by withdrawing from your subscription.
This right applies to consumers. Subscriptions concluded for purposes relating to a trade, business, craft or profession are not covered by it.
All content, features, and functionality of the Service are owned by LuxSign and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of documents you upload, but grant LuxSign a limited license to process them for providing the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LUXEMBOURG LAW:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. LuxSign does not warrant that the Service will meet your requirements or that it will be uninterrupted, timely, secure, or error-free.
You may optionally submit a government-issued identity document (passport, national ID card or driving licence) so that LuxSign can verify who you are. Verification is not required to use the Service; documents can be sent, signed and stored without it.
LuxSign supports all three eIDAS signature levels under EU Regulation 910/2014. Signatures created by drawing, typing or uploading an image are Simple Electronic Signatures (SES). On the Business plan, signing with an eID smartcard produces an Advanced (AES) or Qualified Electronic Signature (QES), depending on the certificate on your card.
In-person signing captures a Simple Electronic Signature (SES) on a device controlled by the host. LuxSign does not authenticate the signer in this flow: no emailed link is used, and no credential or identity document is checked. The record states that the host attested to having verified the signer's identity, and names that host. Every in-person signature is emailed to the signer so that they can identify and dispute a signature made in their name. Where the signer's identity must be established independently of the host, use a Qualified Electronic Signature (QES).
A sender may protect a document with an access code, which the signer must enter before the document can be opened or signed. The code is chosen and shared by the sender; LuxSign stores only a hash of it and cannot recover or disclose it. LuxSign is not responsible for how a sender distributes a code, nor for access obtained by anyone to whom the sender or a signer gives it. Successful entries, failed attempts and lockouts are recorded in the document's audit trail. An access code is an access control only: it adds evidential weight to a Simple Electronic Signature but does not authenticate the signer and does not raise the signature to an Advanced or Qualified Electronic Signature. The code is removed automatically once the document is fully signed, so the parties retain access to the completed document.
When all signatures on a document are complete, LuxSign requests an RFC 3161 time-stamp from an independent time-stamping authority and embeds it in the signed PDF. Only a cryptographic hash of the document is transmitted; the document and its contents are never sent. The time-stamp evidences when the document was signed independently of LuxSign's own clock. Unless expressly stated otherwise, the authority used is not a qualified trust service provider on the EU Trusted List, so the time-stamp is not a qualified electronic time stamp within the meaning of Article 3(34) of the eIDAS Regulation and does not carry the presumption under Article 41. Where the time-stamping authority is unavailable, a document may complete without a time-stamp; this does not affect the validity of the signatures.
For high-value transactions, regulated industries, or legally sensitive documents, we recommend consulting with legal counsel to determine the appropriate signature type for your needs.
LuxSign reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service will immediately cease. You may cancel your account at any time by contacting support [at] luxsign.lu.
LuxSign retains your documents and data as necessary to provide the Service and comply with legal obligations. You may request deletion of your data by contacting support [at] luxsign.lu. LuxSign reserves the right to retain certain data as required by law (including signed documents for up to 10 years under Luxembourg commercial law) or for legitimate business purposes.
You agree to indemnify, defend, and hold harmless LuxSign and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
These Terms shall be governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Luxembourg City.
LuxSign reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically. For material changes, we will provide 30 days advance notice via email.
LuxSign shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and LuxSign regarding the use of the Service.
