HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
GENERAL
THE APPRENTICESHIP AND CERTIFICATION ACT
Subsection 4(4) of the English version of The Apprenticeship and Certification Act is amended by striking out "chair" and substituting "chairperson".
THE BLIND AND DEAF PERSON'S MAINTENANCE AND EDUCATION ACT
The Blind and Deaf Person's Maintenance and Education Act, R.S.M. 1987, c. B60, is repealed.
THE CANCERCARE MANITOBA ACT
The CancerCare Manitoba Act is amended by this section.
Subsection 7.1(5) of the French version is amended
(a) in the section heading, by striking out "rapport" and substituting "projet"; and
(b) by striking out "et lui présente de nouveau le rapport" and substituting "et le lui présente de nouveau".

THE PROVINCIAL COURT ACT
The Provincial Court Act is amended by this section.
Subsection 6(1) is replaced with the following:
Resignation, retirement or appointment to other court
A judge who resigns, retires or is appointed to another court after starting to hear a matter remains seized of the matter for a period of 12 weeks after the effective date of the resignation, retirement or appointment.
Subsection 6(2) is amended
(a) in clause (c), by striking out "or impose sentence" and substituting ", impose sentence or do anything else"; and
(b) in the part after clause (c), by striking out "or retired" and substituting ", retired or been appointed to another court".
Clause 6(3)(b) is amended by striking out "or retires" and substituting ", retires or is appointed to another court,".
THE COURT OF QUEEN'S BENCH ACT
The Court of Queen's Bench Act is amended by this section.
The following is added after subsection 11.17(2):
Judicial compensation report to masters
Masters are entitled to receive the report of a Judicial Compensation Committee appointed under subsection 11.1(2) of The Provincial Court Act at the same time as the judges of the Provincial Court receive it. Subsection 11.1(20) of that Act, respecting the confidentiality of the report, applies to the masters.
Section 35 of the English version is amended by striking out "penalities" and substituting "penalties".
Clause 39(1)(a) of the English version is amended by striking out "additonal" and substituting "additional".
THE CROWN LANDS ACT
Subsection 5(5) of The Crown Lands Act is repealed.
THE DRIVERS AND VEHICLES ACT
The Drivers and Vehicles Act is amended by this section.
Subsections 116.1(1) and (2) of the French version are amended in the section heading by striking out "Saisi" and substituting "Saisie".

THE FATALITY INQUIRIES ACT
Subsection 34(4) of The Fatality Inquiries Act is replaced with the following:
Judge unable to complete inquest
If the judge presiding over an inquest
(a) resigns, retires or is appointed to another court, and is unable to complete the inquest and the required report within the period during which he or she remains seized of the matter under subsection 6(1) of The Provincial Court Act; or
(b) is unable for any other reason to complete the inquest and the required report;
the minister shall direct another provincial judge to complete the matter or to conduct a new inquest.
THE FIRES PREVENTION AND EMERGENCY RESPONSE ACT
Subsection 43(3) of the French version of The Fires Prevention and Emergency Response Act is amended by striking out "l'envoi se fait" and substituting "le lendemain tombe".
THE FUNERAL DIRECTORS AND EMBALMERS ACT
The Funeral Directors and Embalmers Act is amended by this section.
The definition "board" in section 1 is amended by striking out "Board of Administration" and substituting "Funeral Board of Manitoba".
Subsections 2(1) and 7(2) are amended by striking out "Board of Administration" and substituting "Funeral Board of Manitoba".

THE PREARRANGED FUNERAL SERVICES ACT
The Prearranged Funeral Services Act is amended by adding the following after subsection 10(2):
A prosecution for an offence under this Act may be commenced not more than one year after the day on which evidence sufficient to justify a prosecution for the offence came to the knowledge of the board.
THE GAMING CONTROL ACT
The Gaming Control Act is amended by this section.
Section 9.1 of the French version is amended by striking out "adopte et applique" and substituting "adoptent et appliquent".

Section 6 is amended by striking out "an action of replevin has been commenced under subsection 7(2)" and substituting "the garage keeper brings a motion for an interim order for the recovery of personal property referred to in subsection 7(2)".
Subsection 7(2) is amended
(a) in the section heading, by striking out "Replevin action" and substituting "Court proceedings"; and

The office commonly known as the "Members' Allowances Office" is responsible for administering, under the supervision of the Clerk of the Assembly, the regulations respecting members' allowances.
Clause (d) of the French version of the definition "rémunération supplémentaire" in subsection 69(1) is amended by striking out "vice-président" wherever it occurs and substituting "président adjoint".
Despite the wording of subsection 52.6.1(1), the first report of the manager of the Members' Allowances Office under that provision after the coming into force of this section is for the period between the date regulations made by the allowances commissioner to implement the decisions made in his report under subsection 52.7.1(3) come into effect and March 31, 2011.
THE LEGISLATIVE ASSEMBLY MANAGEMENT COMMISSION ACT
Clause 6(b) of The Legislative Assembly Management Commission Act is amended
(a) by adding "the registrar appointed under The Lobbyists Registration Act," after "Auditor General,";
(b) by adding "the Information and Privacy Adjudicator appointed under The Freedom of Information and Protection of Privacy Act," after "the Chief Electoral Officer,"; and
(c) by adding ", the Conflict of Interest Commissioner appointed under The Legislative Assembly and Executive Council Conflict of Interest Act," after "the Children's Advocate".
THE LEGISLATIVE LIBRARY ACT
The definition "officer of the Legislative Assembly" in section 1 of The Legislative Library Act is amended
(a) by adding "the Information and Privacy Adjudicator appointed under The Freedom of Information and Protection of Privacy Act," after "the Chief Electoral Officer,"; and
(b) by adding "the registrar appointed under The Lobbyists Registration Act," after "Auditor General,".
THE LIFE LEASES ACT
Section 34 of The Life Leases Act is amended by renumbering it as subsection 34(1) and adding the following as subsection 34(2):
Exception for property managers
Nothing in subsection (1) prevents a non-profit corporation from acting as the property manager for more than one residential complex.
THE LIMITATION OF ACTIONS ACT
The Schedule to The Limitation of Actions Act is amended as follows:
(a) by replacing item 5 with the following:
5. An application under The Elections Act
(b) in section 17, by striking out "Section 172" and substituting "Section 189";
(c) in section 19, by striking out "The Testators Family Maintenance Act" and substituting "The Dependants Relief Act"; and
(d) in section 21, by striking out "Subsections 41(8)" and substituting "Subsections 41(7) or (8)".
THE MARRIED WOMEN'S PROPERTY ACT
Subsection 7(1) of the French version of The Married Women's Property Act is amended by striking out "détenues" and substituting "détenus".
THE MIDWIFERY ACT
The Midwifery Act is amended by this section.
Clause 2(2)(b) of the French version is amended by striking out "les drogues indiquées" and substituting "les médicaments indiqués".
Clause 50(1)(c) of the French version is amended by striking out "les drogues" and substituting "les médicaments".
THE MINING CLAIM TAX ACT

COMING INTO FORCE
This Act, except sections 15, 33, 47, 55, 64 and 66, subsections 16(4) and 31(6) and clauses 32(a) and (b), comes into force on the day it receives royal assent.
Sections 15, 47 and 66 and subsection 31(6) are deemed to have come into force on October 9, 2008.
Subsection 16(4) is deemed to have come into force on June 13, 2006.
Clauses 32(a) and 33(b) and section 55 come into force on the same day that The Lobbyists Registration Act, S.M. 2008, c. 43, Sch. A., comes into force.
Clauses 32(b) and 33(a) come into force on the same day that section 23 of The Freedom of Information and Protection of Privacy Amendment Act, S.M. 2008, c. 40, comes into force.
Section 64 is deemed to have come into force on June 11, 2009.
