Explanatory Note This note is a reader's aid and is not part of the law. Part 1 of this Act corrects typographical, numbering and other drafting errors. It also makes minor amendments to various Acts. Part 2 amends various Acts to make the provisions that govern the appointment of independent officers of the Legislative Assembly clearer. |

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
GENERAL
THE ANIMAL DISEASES ACT
Subsections 3(2) and (3) of the English version of The Animal Diseases Act are amended by striking out "that might be" and substituting "that may be".
THE ANIMAL DISEASES AMENDMENT ACT
Clause 9(3)(b) of the French version of The Animal Diseases Amendment Act, S.M. 2015, c. 18, is replaced with the following:
b) par substitution, à l'alinéa a), de ce qui suit :
a) à l'égard d'un animal qu'il soupçonne raisonnablement :
(i) d'avoir une maladie,

THE CHANGE OF NAME ACT
Section 9 of The Change of Name Act is amended by striking out "The Child and Family Services Act" and substituting "The Adoption Act".
THE CHILD AND FAMILY SERVICES ACT
The Child and Family Services Act is amended by this section.
Subsection 8(5) is amended
(a) by replacing the section heading with "Appeal to Social Services Appeal Board"; and
(b) by striking out everything after "by the director" and substituting "may appeal the decision to the Social Services Appeal Board by filing a written notice of appeal with the appeal board in accordance with The Social Services Appeal Board Act.".
Subsection 8(6) is replaced with the following:
Social Services Appeal Board Act applies
The provisions of The Social Services Appeal Board Act apply with respect to an appeal under subsection (5).
THE CIVIL SERVICE ACT
Sections 58.1 and 58.2 of The Civil Service Act are repealed.
THE COMMUNITY CHILD CARE STANDARDS ACT
Subsections 12(2) and 19(3) of The Community Child Care Standards Act are amended by striking out "sent by registered mail" and substituting "sent by mail".
THE CONSUMER PROTECTION ACT
The Consumer Protection Act is amended by this section.
Section 237 is amended in clause (e) of the definition "high-cost credit product" by adding "on real property" at the end.
Subsection 243(4) is amended in the part before clause (a) by striking out "and at the prescribed time".
Item 6 in subsection 249(2) is amended in the part before clause (a) by striking out "payable by the borrower" and substituting "payable by, or on behalf of, the borrower".
THE CONTAMINATED SITES REMEDIATION ACT
The Contaminated Sites Remediation Act is amended by this section.
Clause 3(3)(c) of the French version is amended by striking out "protection" and substituting "gestion".
Subsection 3(4) of the English version is amended by replacing the section heading with "Obligations under other Acts".
THE COOPERATIVES ACT
Subsection 236(3) of The Cooperatives Act is amended
(a) by replacing the section heading with "Voting generally"; and
(b) by striking out "mail ballot" and substituting "a method other than a show of hands or ballot".
THE ELECTIONS ACT
Subsection 58(1) of the English version of The Elections Act is amended by striking out "chief financial officer" and substituting "financial officer".
THE EMERGENCY MEASURES ACT
Clause 2(3)(f) of the French version of The Emergency Measures Act is amended by adding "ou celles que lui confie le ministre" at the end.
THE FINANCIAL ADMINISTRATION ACT
Section 1 of The Financial Administration Act is amended by repealing the definition "non-cash expense".
THE FISHERIES ACT
Section 24 of The Fisheries Act is amended by replacing the part before clause (a) with the following:
For the purpose of carrying out the provisions of this Part according to their intent, the lending agency may, with the approval of the Lieutenant Governor in Council, make regulations
THE PREARRANGED FUNERAL SERVICES ACT
Subsection 3(7) of The Prearranged Funeral Services Act is repealed.
THE HIGHWAY TRAFFIC ACT
Clauses 114(1)(a) and (b) of the French version of The Highway Traffic Act are replaced with the following:
a) le fait par la gauche à une distance sécuritaire;
b) ne peut revenir sur sa droite que lorsqu'il se trouve à une distance sécuritaire du véhicule ou de la bicyclette.
THE LANDLORD AND TENANT ACT
The heading for Part III of the French version of The Landlord and Tenant Act is replaced with "INSTANCES CONTRE LES LOCATAIRES CONTINUANT À DEMEURER IRRÉGULIÈREMENT DANS LES LIEUX".
THE MUNICIPAL ACT
The Municipal Act is amended by this section.
Subsection 84.1(4) of the French version is amended by striking out "à la majorité absolue" and substituting "par la majorité de ses membres, plus une voix".
Clause 147.1(2)(a) of the French version is replaced with the following:
a) d'une majorité de ses membres, plus une voix;
THE ORDER OF MANITOBA ACT
The Order of Manitoba Act is amended by this section.
Clause 12(1)(b) is amended by striking out everything after "three years".
The following is added after subsection 12(1):
The President of the Executive Council must designate one of the members of the council as chairperson for a specified term. That term may not exceed the term the member is otherwise permitted to serve under this section.
THE PEATLANDS STEWARDSHIP ACT
The title of the French version of The Peatlands Stewardship Act is amended by striking out "PROTECTION" and substituting "GESTION".
THE PROVINCIAL OFFENCES ACT
S.M. 2013, c. 47, Sch. A (unproclaimed Act amended)
The Provincial Offences Act, as enacted by Schedule A of S.M. 2013, c. 47, is amended by this section.
Section 14 is amended by striking out "A copy" and substituting "Subject to the regulations, a copy".
Subsection 44(2) is amended
(a) in clause (a), by striking out "or a default conviction has been entered against them" and substituting "or the matter has been finally disposed of"; and
(b) in clause (b), by striking out "or the default conviction was entered" and substituting "or the matter finally disposed of".
Section 104 is amended by striking out "a prescribed oath" and substituting "an oath".
Subsection 123(2) of the French version is replaced with the following:

Communication de renseignements — procès-verbaux d'infraction

THE MANITOBA PUBLIC INSURANCE CORPORATION ACT
Subsection 38(1) of the French version of The Manitoba Public Insurance Corporation Act is amended in the definition "sommes assurées" by striking out "résultant d'un contrat d'assurances au tiers ni une" and substituting "en exécution d'un contrat d'assurance responsabilité civile et d'une".
THE PUBLIC SCHOOLS ACT
The Public Schools Act is amended by this section.
Subsection 21.2(2) is repealed.
The centred heading before section 21.9 is amended by striking out "ADVISORY GROUPS AND".
Section 21.9 and clause 21.43(b) are repealed.
Subsection 175(1) and section 193 of the French version are amended in the part before clause (a) by striking out "avec la présente loi" and substituting "avec la présente partie".
THE PUBLIC WORKS ACT
The Public Works Act is amended by this section.
Section 1 is amended by adding the following definition:
"enforcement officer" means a person or class of persons designated under subsection 20(4.1); (« agent d'exécution »)
The following is added after subsection 20(4):
Minister may designate enforcement officers
The minister may designate a person or class of persons as enforcement officers for the purpose of enforcing any provision of this Act or the regulations.
Subsection 20(5) is amended
(a) in the section heading, by striking out "minister and peace officer" and substituting "enforcement officer";
(b) in the part before clause (a), by striking out "the minister or a peace officer authorized to enforce this Act may, where the minister or peace officer, as the case may be," and substituting "an enforcement officer may, where he or she"; and
(c) in clause (b) of the English version, by striking out "minister or peace officer" wherever it occurs and substituting "enforcement officer".
Subsection 22(1) is amended by striking out "The minister, or a peace officer authorized to enforce this Act," and substituting "An enforcement officer".
THE RED RIVER COLLEGE ACT
Section 28 of The Red River College Act is amended by striking out "June 30" and substituting "March 31".
THE REGULATED HEALTH PROFESSIONS ACT
Clause 5(3)(c) of The Regulated Health Professions Act is amended by striking out "a member of the profession" and substituting "a member of a profession".
THE SOCIAL SERVICES ADMINISTRATION ACT
The Social Services Administration Act is amended by this section.
Clause (a) of the definition "établissement de soins en résidence" in section 1 of the French version is replaced with the following:
a) qui sont atteints d'une déficience ou d'un trouble désignés par règlement;
Clause 21(1)(g) of the French version is amended by striking out "déterminer les handicaps et les affections" and substituting "désigner des déficiences et des troubles".
THE SOCIAL SERVICES APPEAL BOARD ACT
The definition "designated Act" in section 1 of The Social Services Appeal Board Act is amended by adding the following after clause (a):
(a.1) The Child and Family Services Act;
THE MANITOBA UKRAINIAN CANADIAN HERITAGE DAY ACT
The Manitoba Ukrainian Canadian Heritage Day Act is amended in the last paragraph of the preamble by striking out "the civic holiday (the first Monday in August)" and substituting "Terry Fox Day".
THE VETERINARY MEDICAL ACT
Subsection 7(3) of the French version of The Veterinary Medical Act is amended in the part before clause (a) by striking out "façon" and substituting "des façons suivantes".
THE VICTIMS' BILL OF RIGHTS
Clauses 12(f) and (g) of The Victims' Bill of Rights are replaced with the following:
(f) the right of a prosecutor, or of a witness, to ask the court that a support person of the witness's choice be permitted to be close to the witness while testifying, as provided in section 486.1 of the Criminal Code (Canada);
(g) the right of a prosecutor, or of a witness, to ask the court to be allowed to testify by closed-circuit television or behind a screen or other device in the court room, as provided in section 486.2 of the Criminal Code (Canada);
THE VITAL STATISTICS ACT
The Vital Statistics Act is amended by this section.
Subsection 14(3) is amended by striking out "the International List of Causes of Death as last revised by the International Commission assembled for the purpose" and substituting "the most recent version of the International Classification of Diseases as published by the World Health Organization".
Subsection 14(4) of the English version is amended by striking out "the International List of Causes of Death as last revised by the International Commission assembled for the purpose" and substituting "the most recent version of the International Classification of Diseases as published by the World Health Organization".
THE WATER RIGHTS ACT
The Water Rights Act is amended by this section.
The definition "plan d'eau" in section 1 of the French version is amended by striking out "marécages" and substituting "terres humides".
Subsection 4(2) of the French version is amended in the section heading by striking out "ordonnance" and substituting "arrêté".
Subsection 17(2) of the French version is amended by striking out "une ordonnance rendue" and substituting "un arrêté rendu".
INDEPENDENT OFFICERS OF THE ASSEMBLY
THE AUDITOR GENERAL ACT
The Auditor General Act is amended by replacing subsection 3(1) with the following:
If at any time the position of Auditor General
(a) will become vacant within six months because the term of office is scheduled to expire or the Auditor General has resigned; or
(b) has become vacant for any other reason;
the President of the Executive Council must, within one month after that time, convene a meeting of the Standing Committee on Legislative Affairs and the Standing Committee must, within six months after that time, consider candidates for the position and make recommendations to the President of the Executive Council.
THE CHILD AND FAMILY SERVICES ACT
The Child and Family Services Act is amended by replacing subsection 8.1(2) with the following:
If at any time the position of children's advocate
(a) will become vacant within six months because the term of office is scheduled to expire or the children's advocate has resigned; or
(b) has become vacant for any other reason;
the President of the Executive Council must, within one month after that time, convene a meeting of the Standing Committee on Legislative Affairs and the Standing Committee must, within six months after that time, consider candidates for the position and make recommendations to the President of the Executive Council.
THE ELECTIONS ACT
The Elections Act is amended by replacing section 22 with the following:
If at any time the position of chief electoral officer
(a) will become vacant within six months because the term of office is scheduled to expire or the chief electoral officer has resigned; or
(b) has become vacant for any other reason;
the President of the Executive Council must, within one month after that time, convene a meeting of the Standing Committee on Legislative Affairs and the Standing Committee must, within six months after that time, consider candidates for the position and make recommendations to the President of the Executive Council.
THE FREEDOM OF INFORMATION AND PROTECTION OF PRIVACY ACT
The Freedom of Information and Protection of Privacy Act is amended by replacing subsection 58.1(1.1) with the following:
If at any time the position of adjudicator
(a) will become vacant within six months because the term of office is scheduled to expire or the adjudicator has resigned; or
(b) has become vacant for any other reason;
the President of the Executive Council must, within one month after that time, convene a meeting of the Standing Committee on Legislative Affairs and the Standing Committee must, within six months after that time, consider candidates for the position and make recommendations to the President of the Executive Council.
THE LEGISLATIVE ASSEMBLY AND EXECUTIVE COUNCIL CONFLICT OF INTEREST ACT
The Legislative Assembly and Executive Council Conflict of Interest Act is amended by replacing subsection 19.5(1.1) with the following:
If at any time the position of commissioner
(a) will become vacant within six months because the term of office is scheduled to expire or the commissioner has resigned; or
(b) has become vacant for any other reason;
the President of the Executive Council must, within one month after that time, convene a meeting of the Standing Committee on Legislative Affairs and the Standing Committee must, within six months after that time, consider candidates for the position and make recommendations to the President of the Executive Council.
THE LOBBYISTS REGISTRATION ACT
The Lobbyists Registration Act is amended by replacing subsection 11(3) with the following:
If at any time the position of registrar
(a) will become vacant within six months because the term of office is scheduled to expire or the registrar has resigned; or
(b) has become vacant for any other reason;
an appointment must be made under this section within six months after that time.
THE OMBUDSMAN ACT
The Ombudsman Act is amended by replacing subsection 2(2) with the following:
If at any time the position of Ombudsman
(a) will become vacant within six months because the term of office is scheduled to expire or the Ombudsman has resigned; or
(b) has become vacant for any other reason;
the President of the Executive Council must, within one month after that time, convene a meeting of the Standing Committee on Legislative Affairs and the Standing Committee must, within six months after that time, consider candidates for the position and make recommendations to the President of the Executive Council.
COMING INTO FORCE
This Act, except sections 2 and 14, comes into force on the day it receives royal assent.
Section 2 is deemed to have come into force on June 30, 2015.
Section 14 comes into force on the same day that the definition "board" in clause 18(a) of The Grieving Families Protection Act, S.M. 2011, c. 29, comes into force.
