Georgia Judge Emily Brantley has now determined a jury will decide whether the AMC network bypassed safety precautions on the set of "The Walking Dead", July 2017, leading to the death of stunt performer John Bernecker:
In AMC's filing, the company's attorneys stated Bernecker assumed all risks associated with the stunt and therefore they were not liable for the accident that resulted in his passing.
"While his death is undoubtedly tragic, under controlling Georgia law, the affirmative defense of assumption of the risk bars Plaintiffs' claims against each of the Defendants because Bernecker, a professional stuntman, understood and appreciated the dangers and risks associated with the high fall and voluntarily attempted the stunt without coercion", the AMC attorneys wrote. The mother of late actor and stuntman John Bernecker filed a wrongful death lawsuit recently in her bid to "seek justice" for her son, placing the blame on AMC for cutting back on budgets for safety precautions on set, according to the Associated Press.

Professional film stuntman John Bernecker has died, following an accident on the set of AMC's "The Walking Dead", during the shooting of Season 8 in Atlanta, Georgia:
"...Bernecker was filming a scene with series regular Austin Amelio that required him to fall approximately 22 feet off of a balcony onto a safety cushion below. But Bernecker landed on his head and neck on the concrete, missing the cushion by 'just inches' according to assistant director Matthew Goodwin. Bernecker was airlifted to an Atlanta medical center, where he was placed on a ventilator. His family opted to turn the ventilator off. John Bernecker, the “Walking Dead” stuntman who died after a planned fall from a balcony went wrong on set Wednesday, missed a safety cushion “just by inches,” an assistant director told police according to TMZ. According to TMZ, assistant director Matthew Goodwin told police that Bernecker failed to get good separation from the balcony when he jumped, and even tried to catch himself by grabbing onto the railing. Bernecker’s momentum caused him to slam into the bottom of the balcony and he fell on his head and neck on a spot of exposed concrete next to where the safety cushion.

“The Walking Dead” stuntman John Bernecker was pronounced dead on Thursday night after an accident while filming, TheWrap has confirmed with Coweta County Coroner’s office. Bernecker fell off a 25 foot high balcony on Wednesday afternoon on the set of the show in Georgia. AMC halted production after the stuntman fell and was rushed to Atlanta Medical Center. “The show isn’t about the the art of dance,” Goodwin says, “It’s about the joy of dancing, and it’s important to communicate energy and fun and to make the campaign entertaining in its own right.”
