A Delaware judge said that a jury will have to decide whether Newsmax engaged in actual malice against Smartmatic as the conservative news outlet amplified claims made by allies of Donald Trump that the voting machine company helped rig the 2020 presidential election.
The ruling from Judge Eric M. Davis is just the latest in a series of lawsuits filed by Smartmatic and another election systems company, Dominion Voting Systems, over claims made by Newsmax, One America News Network and Fox News guests and personalities in the aftermath of the election.

Conservative network Newsmax has been dropped from DirecTV as of 11:50 p.m. Et on Tuesday.
DirecTV confirmed the decision, saying the network is no longer broadcast on DirecTV, DirecTV Stream or U-Verse, with the decision made due to Newsmax’s “demands for rate increases.”
“On multiple occasions, we made it clear to Newsmax that we wanted to continue to offer the network, but ultimately Newsmax’s demands for rate increases would have led to significantly higher costs that we would have to pass on to our broad customer base. Anyone, including our customers, can watch the network for free via NewsmaxTV.com, YouTube.com and on multiple streaming platforms like Amazon Fire TV, Roku and Google Play. We continually evaluate the most relevant programming to provide our customers and expect to fill this available channel with new content,” a DirecTV spokesperson said in a statement.

Dominion Voting Systems filed a $1.3 billion lawsuit against MyPillow CEO Mike Lindell on Monday, claiming that he defamed the company with his repeated allegations that it rigged the election against Donald Trump.
The lawsuit, filed in U.S. District Court, also accuses media outlets including Fox News, Newsmax and One America News Network of giving Lindell a platform to spread “the Big Lie” because they wanted to stay in the good graces of a major sponsor. Smartmatic, a maker of voting technology whose name has been the subject of disparaging commentary from a handful of conservative-news outlets, on Thursday said it had sued Fox News and three of its popular on-air personalities — Lou Dobbs, Maria Bartiromo and Jeanine Pirro — for more than $2.7 billion, citing efforts made on Fox News programs to disparage the company’s business.
Rudy Giuliani and Sidney Powell, two attorneys who had been working for President Donald Trump in his efforts to overturn the results of the 2020 election that resulted in victory for President Joe Biden, are also named in the suit.
“One of the biggest challenges in the Information Age is disinformation,” said Antonio Mugica, CEO of Smartmatic, in a statement. “Fox is responsible for this disinformation campaign, which has damaged democracy worldwide and irreparably harmed Smartmatic and other stakeholders who contribute to modern elections.” The complaint was filed in New York State Court in Manhattan.

MyPillow boss Mike Lindell is one of former President Donald Trump’s most loyal supporters, and this week he went on the right-wing news network Newsmax to try to push the baseless conspiracy theory that voting machine manufacturer Dominion Voting Systems rigged the election in President Joe Biden’s favor. The thing is, Dominion has threatened Newsmax (and Lindell) with a defamation lawsuit that’s serious enough to make Newsmax acknowledge reality. When Lindell kept talking about Dominion after being warned not to because Newsmax was “unable to verify” his claims (that’s the excuse they gave without mentioning the legal threats), anchor Bob Sellers walked out of the interview. It was pretty incredible TV, and Trevor Noah thought it was great.

On Wednesday’s episode of “The View,” Whoopi Goldberg couldn’t stop laughing over a clip of Newsmax co-anchor Bob Sellers walking out of an interview with MyPillow CEO Mike Lindell.
The pillow entrepreneur was banned from Twitter in late January for spreading election fraud conspiracy theories, and he doubled down on those outlandish claims during his Newsmax appearance on Tuesday. It got to the point where Sellers couldn’t take it anymore, so he abandoned his post and walked off in the middle of the interview.
“The subject of election fraud did not go over well when you-know-who loyalist, the MyPillow fellow, was on Newsmax yesterday,” Goldberg said on “The View,” laughing so hard over the clip that she could barely hold it together while asking for co-host Meghan McCain’s opinion.
