After being held incommunicado behind the Iron Curtain for seven years and declared legally dead, Tom Roberts returns to the United States and discovers that his wife, Mary, has remarried and has a son. Even though the second marriage was annulled and Tom and Mary have remarried, there's still the question of custody of the child, Johnny, to be decided. During the trial testimony reveals that Tom and Mary plan to move to Rome, Italy, and the birth father will have little communication with his son. Will that sway the jury to award custody to a single man?
