Kate makes an appearance in court wearing a light blue blouse and gray skirt/jacket and is told to be ready for trial in three days on Monday. She sees the graffiti on her car after leaving the courthouse while still wearing the same outfit. We next see Kate the same day wearing a green dress while the graffiti is being removed. We then see Kate talking to David again wearing the gray and light blue outfit from the courthouse.
Seconds after she is attacked by David and nearly strangled, Kate has no marks on her neck.

The murder is reported to have happened in Point Verde County, yet the court proceedings take place at the Santa Buena County Courthouse. It was too soon for a change of venue to have been granted.
Kate is being attacked by Adrian in her motel room. Within a matter of seconds, we hear police sirens and the Sheriff and deputy arrive to rescue her. No one had time to call them, and even if they were going to check on Kate they would not have done so using sirens.
The judge committed a glaring reversible error by disallowing Kate enough time to prepare her case after being hired. This was only 12 days after the arrest.
Kate tells her dad the Sheriff she didn't see anything seconds after the window was smashed, yet she could have given him at least the generic description of a black pickup and the direction of travel. The Sheriff could have either pursued the truck or at least radioed in a Be On the Look Out to his deputies.
