THE OBJECTION IS FOR: 1. The Plaintiff sued the Queen of England. The Deputy Attorney General named the Attomey General as the Defendant in his motion to dismiss this matter pursuant to Rules 221(1) (a) of the Federal Court Rules instead Her Majesty the Queen (Crown) then named her as the Defendant in the Court Order he composed for a Prothonotary to dismiss the Statement of Claim in its entirety before the Plaintiff files the evidence to support his claim against the CROWN seeking eleven million dollars and proper apologies for its offences against his rights under the Canadian Charter of Rights and Freedoms (Charter) that could be appealed to the Supreme Court of Canada if necessary. 2. The Deputy Attorney General, William F. Pentney QC is not an infant or incompetent. He serves the Plaintiff on the last day pursuant to the Federal Court Rules a vexatious motion in lieu of filing a Statement of Defence then seeks an extension of time to answer if he fails. 1‘THE GROUNDS FOR THE OBJECTION TO THE MOTION TO DISMISS AND THE REQUEST FOR AN ORAL HEARING ARE: 1. ‘The Deputy Attomey General falsely claims that the Plaintiff discloses no reasonable cause of action despite the fact that he later admits within the facts Supporting his motion that the Plaintiff stated that the CROWN had breached his right to peaceful assembly and association pursuant to section 2(c) and (4) of the Canadian Charter of Rights and ‘Freedoms. 2. Due process of law entitles the Plaintiff to provide the Federal Court with the evidence to support his Statement of Claim and to be heard rather than be summarily dismissed in writing by a Prothonotary because the counsel for the Defendant makes allegations that his actions in defence of his rights and freedoms under the Charter are frivolous and vexations or that the Federal Court does not have the jurisdiction to hear a claim against the CROWN. ‘THE FOLLOWING DOCUMENTRY EVIDENCE will be used at the hearing of the Defendant’s Motion to Dismiss. 1. OVERVIEW 1. The Defendant has no grounds to seek an order to strike the Plaintiff's Statement of Claim. In paragraph 6 of the Defendant’s written representation the CROWN admits that the Plaintiff stated that on June 24, 2004 the CROWN began its breach of his right to peaceful assembly and association pursuant to section 2(c) and (4) of the Canadian Charter of Rights and Freedoms (Charter). However the Defendant fails to acknowledge that the Plaintiff'is still barred from all parliamentary properties to this very day. 2. The allegation is obviously false. The party named in this Statement of Claim is HER MAJESTY THE QUEEN as the Plaintiff stated in paragraph 89 of the Statement of Claim, the Federal Court has the jurisdiction to hear this matter pursuant to section 17 (1) of the Federal Courts Act which states as follows: “17. (1) Except as otherwise provided in this Act or any other Act of Parliament, the Federal Court has concurrent original jurisdiction in all cases in which relief is claimed against the Crown” 3, The Plaintiff strongly objects for reasons stated within paragraph 2. 4. The Plaintiff states that after the court reads and listens to the evidence then hears the Plaintiff's arguments during a hearing of this motion in support of his Statement of Claim, the Defendant should consider making an offer to settle with the Plaintiff rather than attempting to write another frivolous defence in order to waste more of the Federal Court's time.PART I-FACTS 5. The first part of this stated “fact” is not true. The Plaintiff is not a resident of New Brunswick. He is in fact still a permanent resident of the United States of America (USA) although he has been homeless for over ten years. The CROWN cancelled the Plaintiff's social insurance number many years ago at about the same time that he was issued an American social security number. ‘A recent act of Parliament does not allow the Plaintiff to vote because of his standing as a non-resident but does not deny him to run for a seat in Parliament. In further support the Plaintiff states that he has not paid income taxes in Canada since 1987 and he does not have a Medicare card issued from any province. In 2010 the CROWN went so far as to refuse to renew his Canadian drivers licence in Nova Scotia for no stated reason whatsoever other than to have unnamed bureaucrats tell him on the phone to take his problems back to New Brunswick or to sue Nova Scotia. The second part of the Defendant’s “fact” is almost true. The Plaintiff did name HER MAJESTY THE QUEEN as the defendant in his Statement of Claim on September 16, 2015. However it is comprised of 53 pages not 52. 6. True 7. Tre 8, Not True. The Plaintiff has been trying to resolve this matter since 2004 but the Plaintiff only explained in paragraph 11 of his Statement of Claim what had occurred on June 16, 2004. He did not state that he was “too busy”. The deeply troubling private family matters were the reason for the delay and the Plaintiff will explain that in a lawsuit following the action. 9. The onus is upon the Defendant to prove he is a liar in order to have the Statement of Claim dismissed. False allegations won't do within a just court of law. It is the facts and the evidence that support this claim. Many words and the same false allegations support by nothing but references to the law by the Defendant have no merit whatsoever. 26. It appears to the Plaintiff that the Defendant’s counsel thinks if they repeat the same argument enough times then perhaps the court will become convinced of their sincerity. The Plaintiff has faith the court will see no merit in the Defendant's motion to dismiss. He truly feels it was just a delay tactic served upon him in the last working hours before polling day of the 42nd Parliament. The Plaintiff ran in the election of the 42nd Parliament and the CROWN Corp known as the CBC ignored its mandate and denied the candidate equal access to be heard. He prays that the Federal Court does not behave like CBC did. In 2004 the Plaintiff was barred by a Conservative provincial mandate within days of his debating the Conservative lawyer, Rob ‘Moore and crossing paths with Stephen Harper. After Harper won a mandate in 2006, the Plaintiff was barred from all parliamentary properties. 1332. The Plaintiff states that it is not plain and obvious that his claim cannot succeed. It is only the Deputy Attomey General’s stated opinion without revealing all the facts to Federal Court. For instance while the Plaintiff was running in the election of the 42" Parliament he sent many emails to many people containing a true copy of his Statement of Claim. The Crown should not deny that Peter MacKay, the outgoing Attomey General, his Deputy Minister William Pentney and the local Justice Dept lawyer David Hansen received the emails found below during the time ofthe election of the 42% Parliament.
