DEED OF WAIVER OF RIGHTS AND PARTITION WITH
VERIFIED PETITION FOR ISSUANCE OF SEPARATE TITLE
KNOW ALL MEN BY THESE PRESENTS:
This DEED made and executed by and between:
ANA T. DELEÑA, of legal age, Filipino, widow and a resident of Bacong,
Negros Oriental, Philippines, hereinafter referred to as the FIRST PARTY;
-and-
ALFREDA TINGCAY SONAJO, of legal age, Filipino, married and a
resident of Bacong, Negros Oriental, Philippines, hereinafter referred to as the
SECOND PARTY;
WITNESSETH:
That the FIRST PARTY is the registered owner of a parcel of land, Lot No.
6466, Cad. 212 equivalent to Lot No. 1, Ccs-07-000618 covered by Original
Certificate of Title No. 10685, situated in Buntod, Bacong, Negros Oriental,
Philippines, consisting of TEN THOUSAND SIX HUNDRED SIXTY-SIX (10,666)
SQUARE METERS, more or less, with all the improvements found thereon, which
parcel of land is more particularly described as follows:
ORIGINAL CERTIFICATE OF TITLE NO. 10685
“A parcel of land (Lot No. 6466, Cad. 212 equivalent to Lot No.
1, Ccs-07-000618), situated in the Barangay of Buntod,
Municipality of Bacong, Province of Negros Oriental, Island of
Negros. Bounded on the NE., along line 9-10 by Lot 5036, Cad.
212; and along line 10-11 by Lot 5425, Cad. 212; on the E., along
lines 11-12-13 by Lot 5061, Cad. 212; on the SE., along line 13-1
by Lot 6467, Cad. 212 equivalent to Lot 2, Ccs-07-000618; on
the SW., along line 2-3 by Lot 5056, Cad. 212; and along lines
3-4-5-6-7 by Lot 5058, Cad. 212; and on the NW., along lines
7-8-9 by Lot 5037, Cad. 212. Containing an area of TEN
THOUSAND SIX HUNDRED SIXTY-SIX (10,666) SQUARE
METERS, more or less.”
WITNESSETH FURTHER:
That for and in consideration of the love and affection of the FIRST PARTY
to the SECOND PARTY, the FIRST PARTY hereby by these presents QUITCLAIM,
TRANSFER and CONVEY unto the SECOND PARTY the entire one half (1/2)
share of my rights, interests and participation over the aforementioned parcel of
land together with all the improvements found thereon, making her as the
absolute co-owner thereof;

That the SECOND PARTY hereby accept the same and expresses gratitude
for the kindness and liberality of the FIRST PARTY;
WITNESSETH FURTHER:
WHEREAS, the FIRST PARTY and SECOND PARTY, for their own interests
and benefits have caused the subdivision of Lot No. 6466, Cad. 212 equivalent
to Lot No. 1, Ccs-07-000618 into TWO (2) sub-lots, duly approved by the
__________________________________, on ______________________, under
______________________, and pursuant to the provision of Article 494 of the
New Civil Code of the Philippines, and by this DEED agreed to partition the
same in the following manner:
1. Lot No. 6466-A, consisting of FIVE THOUSAND THREE HUNDRED
THIRTY-THREE (5,333) SQUARE METERS, more or less, in favor of ANA T.
DELEÑA; and
2. Lot No. 6466-B, consisting of FIVE THOUSAND THREE HUNDRED
THIRTY-THREE (5,333) SQUARE METERS, more or less, in favor of ALFREDA
TINGCAY SONAJO;
FURTHER WITNESSETH:
PREMISES CONSIDERED, we, ANA T. DELEÑA and ALFREDA TINGCAY
SONAJO, hereunto respectfully pray that the Honorable Register of Deeds of
the Province of Negros Oriental, to cancel Original Certificate of Title No. 10685
and issue two (2) separate titles for Lot Nos. 6466-A and 6466-B, consisting of
FIVE THOUSAND THREE HUNDRED THIRTY-THREE (5,333) SQUARE
METERS, more or less, each, in favor of ANA T. DELEÑA and ALFREDA
TINGCAY SONAJO;
