PETITION FOR PROBATE OF A WILL

PETITIONER, by the undersigned attorney, and unto this Honorable Court,

respectfully avers, that:

1. Petitioner, of legal age, and resident of 859 Yale Street, Wack-Wack

Village, Mandaluyong City, is the testator of the last will and testament

dated 03 November 2010;

2. Said last will and testament (photostatic copy only) is hereto attached as

Annex “A” and made an integral part of this petition, the original thereof

to be presented to this Honorable Court at the time of probate;


3. The subscribing witnesses to said will are:

6. Petitioner/testator named in the will SANDRA ANNA STELLA GOLDBERG

and JIM RENE R. GOUDSMIT as executors thereof, are legally qualified to

act as such; and hereby consents and agrees to accept said trust;

7. The property of the petitioner/testator consists mostly of shares of stocks

in various corporations, the gross value of which is estimated to be around

seven million pesos (PhP7,000,000.00). However, in a case for Replevin,

Sum of Money and Damages pending before Branch 212 of Regional Trial

Court, Mandaluyong City, petitioner is also claiming ownership of various

scaffolding equipment, the total actual market value of which, per

appraisal as of 13 March 2010, amounts to ninety-three million, thirty

thousand pesos (PhP93,030,000.00).

8. The petitioner/testator, at the time of the execution of the said will, was

seventy-three (73) years old , of sound and disposing mind, and not acting

under duress, fraud, or undue influence and was in every respect

capacitated to dispose of his estate by will.

PRAYER

WHEREFORE, it is most respectfully prayed unto this Honorable Court that upon

proper notice and hearing, the above-mentioned will be admitted to probate.

Such other relief be granted as shall be deemed just and equitable in the

premises.
