CONTRACT OF LEASE
KNOW ALL MEN BY THESE PRESENTS:
This contract of lease executed and entered into in the City of Davao, Philippines, by and between
ALEXANDER C. ADVINCULA, of legal age, Filipino, married and a resident of Toril, Davao
City, hereinafter called the LESSOR;
and
RUGENE N. BERATO, of legal age, Filipino, single and a resident of Nagsil Village, Mintrade
Drive, Brgy. Centro, Agdao, Davao City, hereinafter called the LESSEE;
WITNESSETH
WHEREAS, the LESSOR is the owner of a Commercial Building situated at Genaro Lao St., Toril
Public Market, Toril, Davao City.
WHEREAS, the lessor hereby, lets and leases unto the LESSEE, and the latter hereby accepts in
lease from the former, that certain portion designated as ________________________ of the said
Commercial Building under the following terms and conditions;
1. The Leased Premise: This contract covers only Door 7 and 8 of the aforementioned
commercial building, containing an area of 40 sq. meters. It is herein expressly stipulated
that the common areas like hallways, whether adjacent or not be occupied by the LESSEE,
his agent, family member, employee or any person acting for and his behalf not to be used,
in any manner and in any degree as a place for goods, products or properties of the
LESSEE, under any circumstances whatsoever. Parking space shall be used for parking of
vehicles only during office hours;
2. Period/Term of Lease: The lease shall be for a period of 1 one (1) year staring August 16,
2019 to July 16, 2020 renewable upon the mutual agreement of the parties subject to annual
escalation of 5% in monthly rental;
3. Terms of Rental Payments: The monthly rental shall be Twenty Thousand Pesos Only (Php
20,000.00) due and payable in advance. It is expressly agreed and understood that payment
of the rental stipulated shall be made without the necessity of demand and without any delay
on any ground whatsoever. Likewise, the LESSEE obligates himself to issue twelve (12)
postdated checks as rental for twelve (12) succeeding months. It is further agreed that a
surcharge/penalty of Php 50.00 per day shall be added on all due and unpaid rentals. Should
the LESSEE terminate this lease before the expiration period, said LESSEE shall notify the
LESSOR thirty (30) days before the intended date of termination provided that the LESSEE
shall pay all the monthly rentals containing the balance of the period of the term of this lease;
4. Use and Purpose: The said leased premises herein leased shall be used only by the
LESSEE exclusively for MEDICAL LABORATORY AND DIGANOSTICS purpose only, that,
however, if, during the period of the lease, the LESSEE shall decide to change the nature
and or purpose of his business he may do so only with the permission and written consent of
the LESSOR;
5. Security Deposit Requirement: Upon the signing of this contract, the LESSEE shall pay unto
the LESSOR a security deposit equivalent to __________________________(_______)
months rentals. The same shall be applied for unpaid water, electrical, telephone bills, other
service utilities and actual damages to the leased premises in case the LESSEE vacate after
the term of the lease. Any balance left will be refunded to the LESSEE after clearing all
unpaid bills. The security deposit is separate from the monthly rental of which the LESSEE is
obligated to pay on the first five (5) days of the applicable month;
of the LESSOR, such extension of lease shall be deem only tolerated as running from
month to month, under the same terms and conditions herein stipulated, and may be
terminated by either party by means of a written notice served upon the other party at
least thirty (30) days in advance;
19. Insolvency of Lessee: If the rental herein stipulated shall be in arrears or unpaid for
at least two (2) consecutive months or if the LESSEE shall at anytime fail or neglect to
perform or comply with any of the convenants, conditions, agreements or restrictions
stipulated, then in any of the above cases this lease contract shall become automatically
terminated and cancelled and said premises shall be vacated peacefully by the LESSEE
for the LESSOR to take over the possession thereof, in which event it shall be lawful for
the latter or any of his authorized representatives to enter into and upon the leased
premises or if the LESSEE refuses to vacate, the LESSOR Is hereby authorized to
padlock the leased premises without incurring any liability, civil or criminal;
