INFORMATION

The undersigned Provincial Prosecutor hereby accuses MARCELINO


SIMON of the crime Estafa, defined and penalized under paragraph 1(b), Article
315 of the Revised Penal Code, as amended by Republic Act No. 10951,
committed as follows:

That sometime in 03 June 2015, in the Municipality of Abulug, Province of


Cagayan, Philippines and within the jurisdiction of this Honorable Court, the
above-named accused did then and there willfully, unlawfully and feloniously
defraud one DARWIN B. ALCANTARA in the following manner, to wit: said
accused received agricultural supplies and farm pesticides from DARWIN B.
ALCANTARA with the express obligation on the part of the said accused to sell
the same and to account for and deliver the proceeds of the sale or to return
the merchandise, if unsold, to DARWIN B. ALCANTARA within the period agreed
upon, but said accused with abuse of trust and confidence, misappropriate,
misapply and convert to her own personal use and benefit the aggregate
amount of TWO HUNDRED TWENTY TWO THOUSAND SEVENTY FOUR & 20/100 (P
222,074.20) PESOS despite repeated demands to her to immediately account
for and remit the proceeds of the sale of [sic] to return the goods, refused and
failed and still refuses and fails to do so, to the damage and prejudice of
DARWIN B. ALCANTARA in the aforementioned amount of Two Hundred Twenty
Two Thousand Seventy Four & 20/100 (P 222,074.20) Pesos.

I HEREBY CERTIFY, under oath, that I have conducted the preliminary


investigation in this case in accordance with law; that the accused was
informed of the charged filed against him and was given sufficient time to
submit countervailing evidence; that the accused did not submit his Counter-
Affidavit and the Affidavits of his witnesses; that on the basis of the evidence on
record, there is sufficient ground to engender a well-founded belief that the
crime charged had been committed and that the above-named accused is
probably guilty thereof.
