Subject: - Engagement of Consultant Consultancy Services for Construction of
Bridge Connecting North Campus From Ghoda Farm on Kataula Khad and Cycle
Track Connecting North and South Campus of IIT Mandi at Kamand.
Agreement No: 38 for the financial year 2017-18.
Awarded Amount: 66, 00,000/-
The above said work was awarded to M/s Geo Design & Research (P) Ltd., B-
10, Krishna Industrial Estate, Opp. B.I.D.C. Gorwa Estate, Vadodara- 390016,
Gujarat vide this office LOA no. IIT Mandi(CW)/SE-889/2017-18/11575-83
dated 09-03-2018 having date of start and completion as 09-03-2018 and 06-07-
2018 respectively. Hence there is delay of 07-07-2018 to 14-02-2019= 223 days.
The delays are being considered upto 14-02-2019 as the work is yet to be
completed, hence it is interim EOT. The provisional/unilateral extension has also
been issued to the agency which is as follows:-

The agency submitted the reasons for this delay vide their letter dated 14-02-
2019 which are hereby justified & recommended as under:-
A. We were asked to attend a meeting (Review Meeting) on 21.03.2018,
communicated under e-mail dated 14.03.2018.In the absence of letter of
award as per clause 7, we consider the date of start for the work under this
contract as 21.03.2018 as explained in our letter No: GDR/Design/250/2018,
dated 28.06.2018.
A. Agency was telephonically informed regarding awarding of work on dated 09-
03-2018 (Letter of Acceptance was sent to them through speed post same day).
Scanned copy of LOA was also send to them on dated 12-03-2018 through email
(attached herewith).At most extension of 4 days from 09-03-2018 to 12-03-2018
can be given on this account.
B. There was an issue regarding the terms & conditions as per proposed
tender document. This brought the work to a temporary point of
stagnation.
B The consultants vide their letter no.GDR/Design/172/2018 dated 05-06-2018
which was in response to this office email dated 04-06-2018 regarding issue of
payment of proof consultancy fee of Rs 10.00 lakhs. There was dispute between
client and consultant regarding who will bear the proof consultancy fee as per the
terms and conditions of contract.
After a long deliberation at various stages/meetings, it was decided that IIT has
to bear the proof consultancy fee and finally the agreement was signed on 28-
08-2018.
Hence the delay w.e.f 05-06-2018 to 28-08-2018=85 days is hereby justified and
recommended for approval.
C. Not deterring from our responsibilities, we kept on submitting required
documents as and when required. We submitted the Preliminary Project
Report (PPR) on 16-10-2018 under our letter No: GDR/2017-18/123/03.A
joint site visit was again arranged on 14-11-2018, which was attended by us
in true earnest and to maintain the progress of the work. Thereafter,
keeping our tradition and the interest of work, we kept on submitting
proposals duly modified as directed from time to time. In this regard, we
draw your kind attention to the following letters:
GDR/2017-18/123/016, dated 22.11.2018.
GDR/2017-18/123/017, dated 03.12.2018.
GDR/2017-18/123/017, dated 27.12.2018.
GDR/2017-18/123/018, dated 31.12.2018.
GDR/2017-18/123/017, dated 12.02.2019.
GDR/2017-18/123/017, dated 15.02.2019.
In spite of our submission, there was no response/ intimation from your
end regarding approval to proposals. This has delayed further work on the
project and the matter of submissions and subsequent approvals remained
inconclusive. The status of the work is same as on today. We therefore
sincerely request you to conclude the matter to go ahead with the project.
C.The firm submitted the Preliminary Project specifying Plan and profile of the
work on dated 05-05-2018.The consultant vide their letter no
GDR/Design/250/2018 dated 28-06-2018 written is response to this office letter
no.IIT Mandi(CW)/SE-889/2018-19/3319-20 dated 25-06-2018,gave the date
wise activities performed by them. These plan and profiles proposals submitted
by the firm were discussed in the Construction Review meeting held on dated
05-09-2018 and 14-11-2018 & they were asked to submit different proposals The
final go ahead regarding the final proposal was given to contractor in
Construction review meeting held on 14-02-2019.
Total justified delay 05-05-2018 to 14-02-2019= 286 days
Less overlapping period as already considered above in B= 85 days
Less 15 days required to submit PPR after submission of inception report as per
agreement = 15 days
Total delay = 186 days
Total justified delay=A+B+C=4+85+186 = 275 days
The delay of 275 days upto 14-02-2019 as interim EOT is hereby justified &
recommended against the existing delay of 223 days(07-07-2018 to 14-02-2019)
without levy of compensation.
