PETITION
COMES NOW, the petitioner, through counsel, most
respectively alleges:

1. That the petitioner, ABEL SARMIENTO FIGURACION,


widow, of legal age, Filipino and resident of Brgy. Calius
Gueco, Concepcion, Tarlac but for the purposes of the
instant petition she may be served with notices and other
processes of this Honorable Court at Baldovino Manalo
Regua Tabilsima Law Firm, Brgy. San Vicente, Tarlac
City;

2. That the Registry of Deeds for the Province of Tarlac is


hereby impleaded as a nominal party being the repository
of all deeds and titles of property as well as the
Department of Agrarian Reform of Tarlac, tasked in the
issuance of the subject title having an official address at
the ROD Building, Tarlac City and Matatalaib, Tarlac
City, respectively, where they may be served with
summons and other processes of this Honorable Court;
3. That, the herein petitioner is the registered owner of the
subject parcel of land with an area of Seven Hundred
Sixty Three (763) square meters, more or less, situated
in Brgy. Calius Gueco, Concepcion, Tarlac embraced
under Transfer Certificate of Title No. 17012 1 with
Emancipation Patent No. A-357067-H;

4. That, petitioner always kept the subject title in a cabinet


together with her other personal documents. After
working away from home, she immediately checked her
personal documents including the said title. However,
despite diligent effort to look for the title, it proved futile.
Hence, the petitioner executed an Affidavit of Loss 2.

5. That the said Affidavit of Loss was caused to be


registered and annotated in the title as Entry No.
2019009572. (Copy of the Memorandum of Encumbrance
is hereto attached and marked as Annex “C”;

6. That the property covered under the subject title was not
delivered to any person or entity and free from liens and
encumbrances;

7. That the original copy of the subject Transfer Certificate


of Title No. 17012 is intact and existing in the files of the
Register of Deeds –Tarlac. Copy of the Certificate of
Existence issued by the Office of the Register of Deeds-
Tarlac, is hereto attached and marked as Annex “D”;

8. That this petition is filed by the petitioner to induce this


Honorable Court to order for the issuance of a Second
Owner’s Duplicate copy of the subject title.

WHEREFORE, it is most respectfully prayed of this


Honorable Court that after due notice and hearing, an ORDER
be issued ordering the Department of Agrarian Reform of
Tarlac to issue a second owner’s duplicate copy of Transfer
Certificate of Title No. 17012 with Emancipation Patent No. A-
357067-H, in the name of the petitioner as well as to register
the same in lieu of the lost original owner’s duplicate copy of
the said title after payment of the required fee.

Consequently, said second owner’s copy to be generated,


issued, registered and be entitled, in all respect, to like faith

Copy of the Affidavit of Loss executed by the Petitioner is hereto attached and marked as Annex “B”;
and credit as the original duplicate, and shall thereafter be
regarded as such for purposes of the Property Registration
Decree (PD 1529), with the lost original duplicate considered
cancelled and be declared as of no further force and effect
whatsoever.
