COMPLAINT-AFFIDAVIT
I, AAAAAAAAAAAAAAAA, of legal age, Filipino Citizen,
widow and a resident of Flores St. Catbangen, San Fernando
City, La Union under oath, hereby declare and state that:
1. Respondent is also of legal age, single, Filipino Citizen and a
resident of San Fernando City, La Union where she may be
served with summons and other court processes;
2. I am one of the legal heirs of my late husband,
QQQQQQQQQQQQQQQ., who died Intestate or without
Will on February 1, 2006. A copy of our Marriage Certificate
and a copy of death report issued by the Almana Group of
Hospitals, Saudi Arabia are here to attached as Annexes
”A” and “B”, successively;
3. My husband and I have children named, XXXXXXXXXXX,
who were born on November 29, 2000 and February 11,
2003, respectively, who are my co-heirs in the estate of my
late husband. A copy of their birth certificates issued by the
Office of the City Registrar of City of Cabanatuan are hereto
attached as Annex “C” and series;
4. On the 5th day of November 2018 at San Fernando City
La Union, out of my knowledge, an Affidavit of Self-
Adjudication with Simultaneous Deed of Absolute Sale was
Executed allegedly between me and the buyer,
SSSSSSSSSSSSSSSSSS. A copy of the Affidavit of Self-

Adjudication with Simultaneous Deed of Absolute Sale is
hereto attached as Annex “D”;
5. The Deed of Sale involves a property left by my late
husband, a parcel of land situated in Catbangen, San
Fernando City, La Union with Transfer Certificate Title No.
RT-3037 covered by Tax Declaration # 93 22 52675
together with all its improvements under Tax Declaration
number 04 022 68596;
6. I did not sign any Affidavit of Self-Adjudication with
Simultaneous Deed of Absolute Sale nor sold the said parcel
of land to anyone especially to the herein Respondent;
7. I cannot possibly execute the above-mentioned Affidavit of
Self-Adjudication because I am fully aware that I am not the
sole heir of my late husband because we have children;
8. In addition to that, it is not proper for me to execute the
said affidavit considering that there are other living
compulsory heirs at the time of death of my late husband
and are equally entitled to their respective shares in the
estate of my late husband;
9. Besides, my children, BBBBBBBBBBBBBBBBBBB, were
still minor at the time of the alleged execution of the
Affidavit of Self-Adjudication with Simultaneous Deed of
Absolute Sale;
10. Moreover, vacating the premises sold is a natural
consequence of selling a property, however, in this instant
case, I am in possession of the house erected within the said
parcel of land and actually residing in there at the very
moment. Hence, it is impossible to conclude that I sold the
said land and all the improvements thereto when I am still in
control and in possession thereof;
11. Furthermore, one of the pledging witnesses,
NNNNNNNNNNNNNNNNNNN, admitted that I did not
sign the Affidavit of Self-Adjudication with Simultaneous
Deed of Absolute Sale nor present at the moment the said
contract was executed. An affidavit of QQQQQQQQQQ is
hereto attached as Annex “E”; and

12. I am executing this affidavit to attest to the truth of the
foregoing allegations, and for the purposes of filing a case of
Falsification of Public Document or such appropriate case as
determined upon investigation against the herein
respondent.
